This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use: 1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certif~ving that the solder used in system contains less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.

JAMES F. GRATHWOHL, being duly sworn deposes and says:
Through our respective Trusts my sister, Emily G. Victoria, and I own the property
known as 25425 Main Road, Cutchogue, New York. The property is on the northwest
comer of the Main Road and Alvahs Lane. I make this affidavit in conjunction with my
application for a Certificate of Occupancy for the structures and for a designation on the
Certificate of Occupancy for the main structure as to the two uses to wit the upstairs use
as a rental apartment and the downstairs use as a commercial office. In the main building
there is also a work area in the rear with a side entrance, a garage with a rear entrance and
a small storage area on the second floor to the north of the stairway that leads to the
apartment. The use of the first floor as a commercial office and the use of the second
floor as a rental apartment existed prior to 1957 and continuously since that date. I know
this from first hand knowledge inasmuch as the property has been owned by my parents
since 1940 and by my sister and me since 1991.
There are four structures on the premises. The main building, an accessory structure,
small metal storage shed and a very dilapidated wooden outhouse.
According to records I have reviewed the main building was built by Henry Wickham of
Southold in or around 1820. In 1940 my father, Corwin Grathwohl, bought the property
and used the first floor of the main structure as his carpentry shop and the second floor
was used for storage until 1950 when its use as a rental apartment began.
The first tenant on the second floor was a Mrs. Klotzer. Over the years the tenants
changed but the second floor apartment was continually rented from the early 1950s until
presently. A chronology of the tenants that occupied the second floor can be provided
upon request. As the Southold Town Building Department records show, there was fire
damage to the second floor apartment in 1986. An application was made to reconstruct
the damage and a Certificate of Occupancy #Z15741 was issued certifying the completion
of the work.
As noted above, the first floor was used as a carpentry shop which was also my father's
office in connection with his carpentry business. My father retired in 1970. Upon his
retirement the downstairs was rented to George Drake who was a naval architect. Mr.
Drake used the first floor as his office until approximately 1985. Immediately following
Mr. Drake's use, it was used by Alice Hussie in her real estate business until 1990 when
Best Buy Fuels became the tenant. After Best Buy Fuels there have been a number of
commercial tenants who rented and used the first floor in their respective businesses. The
first floor has been used commercially since 1940 without a interruption. In 1998 the
front porch of the first floor needed reconstruction which was accomplished and
Certificate of Occupancy #Z-26167 was issued showing the successful completion of that
project.
Based upon records and family lorn I understand that the main part of the large accessory
building that fronts Alvahs Lane existed when my father purchased the property in 1940.
There have been additions to the accessory structure all of which pre-date 1957.
This is to request that a certificate of occupancy be issued for the main building showing
the 1) first floor use as a commercial office, and 2) the second floor use as a rental
apartment, and 3) an accessory ~.
