THIS INDENTURE, made the ;?07T__day of September, nineteen hundred and ninety-nine BETWEEN JULIAN L. FIEDLER and BERTHA R. FIEDLER, husband and wife, both residing at 427 Seventh Street, Greenport, New York 11944 party of the first part, and JUDITH LIGHT, residing at 35 Village Line Road, Babylon,New York 11702, and RICHARD A. FIEDLER, residing at 1380 Beach Road, Greenport,New York 11944 party of the second part, DISTRICT SECTION BLOCK LOT fG = =` WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate, lying and being west of the Incorporated Village of Greenport, Town of Southold, County of Suffolk and State of New York, eing a portion of Lots Nos. 43 and 44 on "Plan of the S. Buel Corwin Estate, Greenport, New York, as laid out in lots in 1882, resurveyed June 1904,for Referee's Sale July 2, 1904, surveyed by C. H. Bateman, Engineer and Surveyor", said premises being described with reference to said Map as follows:- BEGINNING at the southeast corner of lot number 44 and being at the intersection of the westerly line of Seventh Street with the northerly line of Corwin Street; RUNNING THENCE North 88 degrees 38 minutes 20 seconds West, 100.06 feet along the northerly line of Corwin Street to the southwest corner of lot number 43; THENCE North 07 degrees 06 degrees 20 seconds East, 63.00 feet to land now or formerly of Martocchia; THENCE along said land now or formerly of Martocchia, South 88 degrees 37 minutes 50 seconds East, 100.11 feet to the westerly line of Seventh Street; THENCE South 07 degrees 09 minutes 00 seconds West, 63.00 feet along westerly line of Seventh Street to the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed from Camile Martochia dated September 16, 1936, and recorded in the Suffolk County Clerk's Office on September 17, 1936, in Liber 1882 page 512. RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings and improvements thereon erected, in and to the party of the first part. THE PARTY OF THE FIRST PART. HEREBY RESERVES A SPECIAL POWER OF APPOINTMENT, exercisable as often as they may choose, to change their remainderman as follows: TO or among any one or more members of a class consisting of the party of the first part's descendants, in any degree, whether presently living or born hereafter, in such proportions and amounts, without regard to equality, outright or in trust, as the party of the first part may direct and appoint during their lifetime by a properly written and acknowledged instrument, and recorded prior to death, making specific reference to this power of appointment. The party of the first part may not appoint themselves, their estates, their creditors or the creditors of their estate, under any circumstances. TOGETHER with all right, title and interest, if any,.of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
