RESOLVED that the Town Board of the Town of Southold hereby authorizes
the refund of $75.00 to William Bo~/Ihart, who filed an appeal with the Board
of Appeals on October 21, 1985, and subsequently amended his building permit
application, thereby eliminating the need for an appeal, which h~ad not been
processed by the Board of Appeals.

Last Monday, William J. 8oylhart applied for a variance to
locate an accessory antenna tower (ll' high) at the side of
his existing residence.
Today Mr. Boylhart

was advised that in locating the antenna
as part of the principal structure, a

Mr. Boylhart has amended his building permit to reflect this
change and has requested a refund of the $75.00 filing fee
for the variance application(to be withdrawn).
Since it has been two days since the filing of his variance,
no research or other input has been provided, and it is
recommended that a refund of $75.00 be sent to Mr. Boylhart,
t370 Latham Lane, Orient, New York.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because
If antenna is placed, per existing zoning ordinance, in rear
yard of residence it will obstruct views of beach and Long
Island Sound of Appellant and of neighbors.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because
Lot is located on an extreme point of the coastline at Orient
Point and any construction in the rear yard would be more
visible than any other waterfront lot in this development.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
Antenna and screen will be located in the West side yard of
residence close to building and visually ~a~%e~ -~-to avoid
any visual interferrence. Because of proposed location in
the side y~rd, the construction would result in maintaining
the full view of beach and waterfront for all homes in the area.
