THIS INDENTURE, made the 21st day of December, Two Thousand Eleven
BETWEEN
MARK A. MYSLIBORSKI, residing at 1500 Stars Road, East Marion, New York 11939,
party of the first part, and
RACHEL MYSLIBORSKI and MARK A. MYSLIBORSKI, JR., wife and husband, residing at
284 Toby Hill Road, Westbrook, Connecticut 06498,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at East Marion, Town of Southold, County of Suffolk and State
of New York, known and designated as Lot No. I0 on a certain map entitled "Map of Soundcrest
Woods, Section 1" and filed in the office of the Clerk of the County of Suffolk on June 9, 1969
as Map No. 5315, said lot being more particularly bounded and described as follows.
BEGINNING at a point on the easterly side of Stars Road distant 1463.03 feet as measured in a
northerly direction from the comer formed by the intersection of the northerly side of Main Road
with the easterly side of Stars Road;
RUNNING THENCE along the easterly side of Stars Road, North t0 degrees 17 minutes 20
seconds West, 105 feet;
THENCE North 79 degrees 42 minutes 40 seconds East, 195.59 feet;
THENCE South 10 degrees 49 minutes 30 seconds East, 105.01 feet;
THENCE South 79 degrees 42 minutes 40 seconds West, 196.54 feet to the point or place of
BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated November 6, 2001, and recorded December 10, 2001, in the Office of the Suffolk
County Clerk in Liber 12157, Page 535.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
