THE PARTIES OF THE FIRST PART HEREBY EACH RETAIN A LIFE ESTATE IN
THE PREMISES HEREIN CONVEYED.
TOGETHER, with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the fust part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose.
AND the party of the first part covenants as follows; that said party of the first part is seized of the said premises
in fee simple, and has good right to convey the same; that the party of the second part shall quietly enjoy the said
premises; that the said premises are free from encumbrances, except as aforesaid; that the party of the first part
will execute or procure any further necessary assurance of the title to said premises; and that said party of the
first part will forever warrant the title to said premises.
The word"party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

SCHEDULE "A"
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in the Town of Southold, at Arshamomoque, County of Suffolk and State of New
York, bounded and described as follows:
BEGINNING at a triangular concrete monument set at the Southeasterly intersection of that course of
the Southeasterly boundary line of land of Adam Pekunka which runs North 52 degrees 20m minutes East
with that course of the easterly boundary line of land of said Pekunka which runs South 26 degrees 53
minutes 50 seconds East and running along land now or formerly of Frank Horn on the direct extension
Northeasterly of said Southeasterly boundary line North 52 degrees 20 minutes East, 23 feet to an iron pipe;
thence along said land now or formerly of Frank Horn two courses as follows: South 48 degrees 36 minutes
East 101.16 feet to an iron pipe; thence South 64 degrees 12 minutes East and passing through an iron pipe 64
feet more or less, to the Creek; thence westerly and then southerly along said Creek about 70 feet to the land
now or formerly of Frank Carlucci; thence along land now or formerly of Frank Carlucci, the following two
courses and distances: (1) North 61 degrees 01 minutes West and passing through an iron pipe 60 feet, more
or less, to an iron pipe; and (2) thence North 48 degrees 32 minutes West 109.91 feet to an iron pipe and said
land of Pekunka; thence along said land of Pekunka, North 52 degrees 20 minutes East 37 feet to the point or
place of BEGINNING, Said premises known as 11 Island View Lane, Greenport, New York.
TOGETHER with a right of way over said land of Frank Horn northwesterly along said land of
Pekunka and then northeasterly and then easterly to Island View Lane, as same now exists.
SUBJECT, HOWEVER, to the right of said Frank Horn, his heirs, assigns and grantees to pass and
repass for all purposes over the northeasterly or northwesterly twenty-three (23) feet of said premises.
TOGETHER WITH all the right, title and interest of the parties of the first part of, in and to such
portion of said Creek as abuts the premises.
The parties of the second part shall also have an equal right with the said Frank Horn and with other
owners of land along the Creek of access to Peconic Bay.
The parties of the second part shall also have an equal right with said Frank Horn and with other
persons to whom the said Frank Horn may convey to the use for bathing and incidental purposes of an area
fronting on Peconic Bay for a distance of two hundred (200) feet, the northerly line of said area to be two
hundred (200) feet south of the southerly line of land of Horton Barr and lying between a proposed private
road and Peconic Bay.
SUBJECT to any state of facts an accurate survey may show, provided same does not render title
unmarketable.
SUBJECT to covenants and restrictions of record; covenants contained in deed dated July 3, 1969,
recorded in the Office of the Suffolk Count4y Clerk, in Liber 6583, page 530.
