THIS INDENTURE, made the qday of July, nineteen hundred and ninety-eight BETWEEN ANDREW J. FICURILLI and DENISE FICURILLI, husband and wife, both residing at 58 Wilmarth Avenue, Greenport, New York 11944 party of the first part, and ANTHONY CLAUDIO and MARY MURPHY CLAUDIO, husband and wife, both residing at (No#)Wickham Avenue, Mattituck, New York 11952 party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate, lying and being at Greenport, Town of Southold, County of Suffolk and State of New York, known and designated as Lots 39 and 40 on a certain map entitled, "Map of Washington Heights, Greenport, New York" filed in the Office of the Clerk of Suffolk County, December 29, 1927, as Map Number 651, bounded and described according to said map as follows: BEGINNING at a point on the northerly side of Wilmarth Avenue distant 776.63 feet westerly as measured along the northerly side of Wilmarth Avenue from the corner formed by the intersection of the northerly side of Wilmarth Avenue and the southwesterly side of Main Street; RUNNING THENCE South 87 degrees 36 minutes 50 seconds West along the northerly side of Wilmarth Avenue, 99.29 feet to land now or formerly of N. & E. Beebe; THENCE North 04 degrees 01 minutes 30 seconds West, along the last mentioned land, 152.59 feet to land now or formerly of Horton; THENCE;North 87 degrees 48 minutes 30 seconds East, along the last mentioned land, 103.66 feet to the; division line between Lot 38 and 39 as shown on the above mentioned map; THENCE South 02 degrees 23 minutes 10 seconds East, along the last mentioned division line, 152.16 feet to the northerly side of Wilmarth Avenue at the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed from Clark Lemily as Executor of the Last Will and Testament of Douglas V. Clark, deceased, dated October 19, 1993, and recorded in the Suffolk County Clerk's Office on November 4, 1993, in Liber 11650 page 734. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets .and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything; whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
