MALINAUSKAS, residing at 2520 Ackerly Pond Lane, Southold, New York 11971 party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate, lying and being in Arshamomoque, Town of Southold, County of Suffolk, State of New York, bounded and described as follows:- BEGINNING at a point on the easterly line of Queens Street, 243.25 feet south of the south line of North Road; RUNNING THENCE North 72 degrees 56 minutes 30 seconds East, 221.60 feet along the land of Antone Malinauskas to an iron pipe; THENCE along the land of the Conklin Estate in a northwesterly direction, 180.65 feet to other land of the Estate of Ignas Malinauskas; RUNNING THENCE along said land, in three courses: (1) South 52 degrees 3130 seconds West, 30.0 feet; thence (2) North 37 degrees 35 minutes 40 seconds West,�15.J0 f , thence (3) South 57 degrees 39 minutes 20 seconds Wotrt_1i—.U-Teet to the easterly line of Queens Street, a point 100 feet southerly from the south line offtorth Road; THENCE along said easterly line of Queens Street in a southerly direction, 143.25 feet to the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed from Charles Malinauskas dated November 24, 1978, and recorded in the Suffolk County Clerk's Office on December 7, 1978, in Liber 8545 page 427. RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings and improvements thereon erected, in and to the party of the first part. THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF APPOINTMENT, exercisable as often as she may choose, to change her remainderman as follows: TO or among any one or more members of a class consisting of the party of the first part's descendants, in any degree, whether presently living or born hereafter, in such proportions and amounts, without regard to equality, outright or in trust, as the party of the first part may direct and appoint during her lifetime by a properly written and acknowledged instrument, and recorded prior to death, making specific reference to this power of appointment. The party of the first pat may not appoint herself, her estate, her creditors or the creditors of her estate, under any circumstances. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and al; the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the'same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
