THIS INDENTURE, made the :�4'41 day of November, nineteen hundred and ninety-eight BETWEEN ELIZABETH B. HANFF, residing at 182 Sterling Street, Greenport,NY 11944, as surviving tenant by the entirety party of the first part, and LESLIE H. KALINICH, residing at 10 Squires Path,East Hampton,NY 11937 party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, PARCEL I: ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate, lying and being in the Village of Greenport, Town of Southold, County of Suffolk and State of New York, bounded and described as follows:- BEGINNING at a point on the northerly side of Sterling Street so called, at a locust stake distant 100.12 feet westerly from the land formerly belonging to the Estate of Samuel Salata, deceased; RUNNING THENCE westerly along the northerly line of Sterling Street so called, 30 feet to other land formerly of J. Wesley Ketcham and M. Iduella Ketcham, his wife; THENCE northerly by land formerly of said J. Wesley Ketcham and M. Iduella Ketcham, 90 feet; THENCE northeasterly to the westerly line of land conveyed by the D. & H. Oyster Company to Charles B. Crane and now owned by Frank M. Nikla which said point is distant 115 feet from said locust stake above referred to; RUNNING THENCE southerly by and with the westerly line of land conveyed by the D. 7 H. Oyster Company to Charles B. Crane and now owned by Frank M. Nikla, 115 feet to the point and place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed from Cora S. Webb dated January 13, 1950, and recorded in the Suffolk County Clerk's Office on January 16, 1950, in Liber 3036 page 590. PARCEL H: ALL THAT CERTAIN plot, piece or parcel of land with the buildings and improvements thereon erected, situate, lying and being in the Village of Greenport, Town of Southold, County of Suffolk and State of New York, and bounded and described as follows:- BEGINNING at a pipe set on the northerly line of Sterling Street at the southwesterly corner of land now or formerly of David W. Webb Estate, and running westerly along said northerly line of Sterling Street 12 feet to a pipe; THENCE northerly along other land now or formerly of Charles L. Hanff and Severina Hanff on a line at right angles to said northerly line of Sterling Street 116.75 feet to a pipe; THENCE easterly along said lands now or formerly of Hanff on a line parallel to said northerly line of Sterling Street 42 feet to a pipe set on the westerly line of land now or formerly of Henry Escalette; THENCE southerly along said land now or formerly of Henry Escalette 2.4 feet to a pipe set at the northeasterly corner of said land now or formerly of David W. Webb Estate; THENCE southwesterly along said land now or formerly of David W. Webb Estate, 38.6 feet to a pipe; THENCE southerly along said land now or formerly of David W. Webb Estate on a line at right angles to said northerly line of Sterling Street 90 feet to the point of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed from Charles L. Hanff and Severina Hanff, his wife, dated January 14, 1950, and recorded in the Suffolk County Clerk's Office on January 16, 1950, in Liber 3036 page 593. PARCEL III: ALL THAT CERTAIN plot, piece or parcel of land erected, situate, lying and being in the Village of Greenport, Town of Southold, County of Suffolk and State of New York, bounded and described as follows:- . BEGINNING at a point in the northerly line of Sterling Street, 157.45 feet southeast of the intersection of the said northerly line of Sterling Street and the easterly line of Main Street; RUNNING THENCE North 21 degrees 00 minutes 00 seconds East, 119.75 feet; THENCE South 67 degrees 56 minutes 50 seconds East, 4.0 feet; THENCE South 21 degrees 00 minutes 00 seconds West, 119.75 feet to the said northerly line of Sterling Street; THENCE along the northerly line of Sterling Street, North 67 degrees 56 minutes 50 seconds West, 4.0 feet to the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed from J. Walter Hanff and William H.,Hanff, dated January 25, 1994, and recorded in the Suffolk County Clerk's Office on February 2, 1994, in Liber 11663 page 051. RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings and improvements thereon erected, in and to the party of the first part. THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF APPOINTMENT, exercisable as often as she may choose, to change her remainderman as follows: TO or among any one or more members of a class consisting of the party of the first part's descendants, in any degree, whether presently.living or born hereafter, in such proportions and amounts, without regard to equality, outright or in trust, as the party of the first part may direct and appoint during her lifetime by a properly written and acknowledged instrument, and recorded prior to death, making specific reference to this power of appointment. The party of the first part may not appoint herself, her estate, her creditors or the creditors of her estate, under any circumstances. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to 11932PU26 receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
