WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,

designated as Lot No. 5 as shown on a certain map entitled, "Map of Paradise by the Bay" and filed in the
Section Office of the Clerk of the County of Suffolk on November 4, 1976 as Map No. 6463, said lot being

Block BEGINNING at a point on the easterly side of Kimberly Lane distant 724.45 feet southerly from the

Lot RUNNING THENCE North 89 degrees 14 minutes 00 seconds East 369.32 feet;

THENCE South 84 degrees 22 minutes 20 seconds West 353.48 feet to the easterly side of Kimberly
Lane;
THENCE along the easterly side of Kimberly Lane the following two (2) courses and distances:
1) North 18.degrees 14 minutes 10 seconds West 20.00 feet;
2) Northerly along the arc of a curve bearing to the right having a radius of 420.00 feet a distance of
146.89 feet to the point or place of BEGINNING.

10247, cp 70.
SAID PREMISES being the same premises conveyed to the party of the first part by deed dated 4/13/88,
recorded 6/3/88, in Liber 10616, Page 461.
SAID PREMISES being known as 825 Kimberl)Lane, Southold, New York 11971.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
erationas-a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
