This Indenture, made the lql day of July, Nineteen Hundred and Ninety-Eight
Between ARTHUR SWAN, residing at 512 Fifth Street, Greenport, NY 11944,
party of the first part, and ARTHUR SWAN and ROBERT FRANKLIN HOOD as Joint Tenants with Right
of Survivorship, residing at 512 Fifth Street, Greenport, NY 11944,
party of the second part,
Witnesseth, that the party of the first part, in consideration of Ten Dollars and other
valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Village of Greenport, Town of Southold, County of
Suffolk, State of New York, said lot being more particularly bounded and described as
follows:
BEGINNING at a point on the easterly side of Fifth Street which point is 127.54 feet
northerly along said easterly line of Fifth Street from the intersection of said easterly
line of Fifth Street from the northerly line of Wiggins Street; from said point of beginning
running thence along said easterly side of Fifth Street North 6 degrees 54 minutes 20 seconds
East 50.0 feet to land now or formerly of Aanstad; running thence along land last mentioned
South 82 degrees 34 minutes 10 seconds East 165.86 feet to land now or formerly of
Hammesfahr; running thence along land last mentioned South 6 degrees 51 minutes 40 seconds
West 48.08 feet to land now or formerly of Shapiro; running thence along land last mentioned
North 83 degrees 14 minutes 00 seconds West 165.90 feet to said easterly line of Fifth Street
and the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the grantor herein in deed dated July
13, 1973, recorded on July 19, 1973 in Liber 7445, cp 463.
Together with all right, title and interest, if any, of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof;
Together with the appurtenances and all the estate and rights of the party of the first part
in and to said premises; To Have and to Hold the premises herein granted unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.
And the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to the payment of
the, cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.
