HomeMy WebLinkAboutL 11929 P 422 vow Uc ep- C l og S S THIS INDENTURE made the 10th day of beambe, nineteen hundred and ninety-ayrti6ROAAI, A e 1T� BETWEEN PETER CUNEO residing at 151-64 27th, Avenue, Flushing, New York 11354 L /L as executor of Last Will and Testament of EVELYN CUNEO, late of Queens County, deceased, File- No. 2452/97 party of the first pan, and ZOE CUNEO, residing at 138 1/2 West Glaucus Avenue, Leucadia, CA 92024 ; and ANN O' KEEFE, residing at 85 Aidmore Street, Hamden, CT; and PETER CUNEO, residing at 151-64 27th Avenue, Flushing, New York, as tenants in common party of the second part, WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by said Last Will and Testament and in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the building thereon erected, situate, lying and being near the Village of Greenport, Town of Southold, County of Suffolk and State of New York, known and designated as Lot No. 86 on a certain map entitled :Map of Eastern Shores at Greenport, Section II" filed in the Office of the Clerk of the County of Suffolk on August 10, 1965 as Map No. 4426. Together with the use of the beach area as described in deed made by H.J.S. Land and Development Corp. and J.M.S. Land and Development Corp. to Eastern Shore, Inc., dated March 17, 1965 and recorded in the Suffolk County Clerk's Office on March 18, 1965 in Liber 5716, Page 16 and together with access thereto from the premises herein described over Sound Drive. Together with a right of way of ingress and egress to Middle Road over the roads shown on Map of Eastern Shores at Greenport, Section 2. Said premises being the same conveyed to the Grantor by Deed dated December 28, 1993 recorded with the office of the Clerk of the County of Suffolk on January 12, 1994 in Liber 11659, Page 788. TOGETHER with all right,title and interest, if any,of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part io and to said premises; TO HAVE AND TO HOLD the premises herein granted unto die party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law,covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvements and will apply the same first to the payment of the cost of the improvement before using any part of the total of the`1same for any other purpose. The word "party" shall be construed as if it read "parties"whenever the sense of this indLnture so requires.
