as executor of the last will and testament of ARTHUR LEVINE, late
of Greenport, New York, deceased,
party of the first part, and
DAVID ABATELLI and LYDIA C. ABATELLI, residing at 28675 Main Road,
Cutchogue'�NY 11935
party of the second part,
WITNESSETH, that the party of the first part, by virtue of the
power and authority given in and by said last will and testament,
and in consideration of ONE HUNDRED NINETY THOUSAND AND 00/100
($190, 000 . 00) dollars, paid by the party of the second part, does
hereby grant and release unto the party of the second part, the
heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, with the buildings
and improvements thereon erected, situate, lying and being in the
Incorporated Village of Greenport, Town of Southold, County of
Suffolk and State of New York, being more particularly bounded and
described as follows :
BEGINNING at a point on the westerly side of Main Street distant
16 . 5 feet southerly from the corner formed by the intersection of
the southerly side of Adams Street with the westerly side of Main
Street;
RUNNING THENCE South 7 degrees 1 minute 20 seconds East along the
westerly side of Main Street 52 .70 feet to land now or formerly of
Klipp Estates;
RUNNING THENCE along said last mentioned land South 83 degrees, 20
minutes 20 seconds West 40 . 69 feet to land of unknown owner;
THENCE along said last mentioned land the following three courses
and distances :
1. North 06 degrees 51 minutes 40 seconds West 15 . 60 feet;
2 . South 83 degrees 33 minutes 30 seconds West 17 . 92 feet;
3 . North 06 degrees 25 minutes 30 seconds West 36 . 75 feet to land
now or formerly of Claudio; and
THENCE along said last mentioned land North 83 degrees 04 minutes
40 seconds East 58 . 17 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the grantor
herein and Sylvia B. Levine, his wife, who died on March 30, 1981
by deed dated January 4, 1961 and recorded on January 5, 1961 in
Liber 4931, cp 79 .

TOGETHER with all of the right, title and interest of the parties
of the first part of, in and to a strip of land generally bounded
and described as follows : on the north by land of Claudio, on the
east by Main Street, on the south by the northerly line of
premises above described and on the west by a right of way.
TOGETHER with the right to the use (in common with others) of a
right of way approximately 8 feet in width running from the
southwesterly corner of the premises first above described
northerly to Adams Street .
RESERVING to the parties of the first part, their heirs,
distributees and assigns, the right to the use of the aforesaid
right of way approximately 8 feet in width running southerly from
Adams Street to other premises of the parties of the first part,
for ingress and egress to' and from said other premises and to and
from Adams Street, and for the continued use, operation,
maintenance and repair of existing sewer and water lines .
TOGETHER with all right, title and interest, if any, of the party
of the first part in and to any streets and roads abutting the
above described premises to the center lines thereof; TOGETHER
with the appurtenances, and also all the estate which the said
decedent had at the time of decedent ' s death in such premises, and
also the estate therein, which the party of the first part has or
has power to convey or dispose of, whether individually, or by
virtue of said will or otherwise; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the
first part has not done or suffered anything whereby the said
premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of
the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied
first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any
other purpose.
The word "party" shall be construed as if it read "parties"
whenever the sense of this indenture so requires .
IN WITNESS WHEREOF, the party of the first part has duly executed
