THIS INDENTURE, made the 10th day of April, nineteen hundred and ninety-seven
BETWEEN
KATHLEEN AHEARN, residing at 85 Lafayette Avenue, Sea Cliff, New York, 11579;
THOMAS FITZMAURICE, residing at 23 Spencer Drive, Bethpage, New York, 11714;
ELLEN FERRARA, residing at 10 Bailey's Causeway, Minot, MA, 02055; and
PATRICIA KRAUS, residing at 3 North Court, Port Washington, New York, 11050, as
tenants in common
party of the first part, and
CHRISTOPHER PLIACONIS, residing at 20 Bantry Court, Huntington, NY 11743
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN;plot, piece or parcel of land, situate, lying and being in the Town of
Southold, County of Suffolk and State of New York, known and designated as Lot 38 on a
certain map entitled, "Map of Cleaves Point, Sec. 2", and filed in the Office of the Clerk of
the County of Suffolk on March 13, 1962 as Map No. 3521, being more particularly bounded
and described as follows:
BEGINNING at a point on the southeasterly side of Snug Harbor Road (private) where the
same is intersected by the division line between Lots 37 and 38 on the aforesaid map, said
point or place of beginning being also distant 80.28 feet northeasterly as measured along the
southeasterly side of Snug Harbor Road from the corner formed by the southeasterly side of
Snug Harbor Road and the northeasterly side of Snug Harbor Road;
RUNNING THENCE along the southeasterly side of Snug Harbor Road, North 19 degrees 30
minutes 00 seconds East ;10.00 feet to the division line between Lots 38 and 39;
THENCE along said lasttmentioned division line South 70 degrees 49 minutes 20 seconds East
141.92 feet to the division line between Lots 39 and 44;
THENCE along said lash mentioned division line South 22 degrees 30 minutes 20 seconds
West 70.00 feet to the division line between Lots 37 and 38;
THENCE along said last mentioned division line North 86 degrees 58 minutes 40 seconds
West 144.17 feet to the southeasterly side of Snug Harbor Road at the point or place of
BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by
deed dated January 16, 1973 recorded in the Office of the Clerk of the County of Suffolk on
January 19, 1973 in Liber 11473 page 193.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof, TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the y of the first part has duly executed this deed the day and year
first above written.
