THIS INDENTURE, made the i�/O� day of October, 1999 BETWEEN
JOSEPH STANLEY ZUREK, a/k/a STANLEY J. ZUREK, residing at 250 Carroll Avenue, Peconic,
New York, 11958
as Executor of the Last Will and Testament of KATHERINE ZUREK a/k/a KATARZYNA ZUREK
late of Suffolk County, deceased, Surrogate's Court Pile Number 189P99
party of the first part, and
JOSEPH STANLEY ZUREK, a/k/a STANLEY J. ZUREK, residing at 250 Carroll Avenue, Peconic,
New York, 11958
party of the second part,
WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by said last
will and testament and in consideration of ONE ($1.00) dollars,
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon, situate,
lying and being on the southerly side of Carroll Avenue, at Peconic, Town of Southold, Suffolk County and
State of New York, more particularly bounded and described as follows:
BEGINNING at an iron pipe located on the southerly side of Carroll Avenue and the northeast corner of land
now or formerly of Smith; thence running in an easterly direction along the southerly line of Carroll Avenue,
North 52 degrees 37 minutes 20 seconds east, 154.50 feet, to an iron pipe; thence running in a southerly
direction along the westerly line of land now or formerly of Murphy, South 30 degrees 31 minutes 50
seconds East 206.14 feet to an iron pipe and the northerly line of the land of the Peconic School; thence
running in a westerly direction along the land of the Peconic School, South 51 degrees 05 minutes 00
seconds west 155.93 feet to a concrete monument located on the easterly line of the land now or formerly of
Smith; thence running in a northerly direction along the easterly line of the land now or formerly of Smith
North 30 degrees 17 minutes 40 seconds West 210.44 feet, to the iron pipe the point or place of
BEGINNING.
TOGETHER with all the right title and interest of the patty of the first part in and to Carroll Avenue, the
center line thereof.
BEING AND INTENDED TO BE the same premises conveyed to Piotr Zurek and Katherine Zurek, both
deceased, by deed dated the 15`h day of March, 1960 recorded in the Office of the Clerk of the County of
Suffolk on the 17°1 day of March, 1960 in Liber 1782 page 217.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances, and also all the estate which the said decedent had at the time of the decedent's death in said
premises, and also the estate therein, which the party of the first part has or has power to convey or dispose
of, whether individual, or otherwise;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not clone or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first
above written.
