JOSEPH and ELIZABETH BRITTMAN #6522 SCTM#1000-78-2-11.3 JOSEPH and ELIZABETH BRITTMAN #6522 - Request for Variance from Article III, Code Section 280- 15 and the Building Inspector's October 3, 2011, Notice of Disapproval based on a building permit application to construct an accessory garage, at; 1 ) more than the code required maximum square footage of 750 sq. ft. on lots 20,000-60,000 sq. ft., located at: 80 Glenn Road (Main Bayview Road) Southold, NY. SCTM#1000-78-2-11.3 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below listed policy standard and therefore INCONSISTENT with the LWRP. Policy Standards 3.1 Enhance visual quality and protect scenic resources throughout the Town of Southold. Minimize introduction of structural design components (including utility lines, lighting, signage and fencing) which would be discordant with existing natural scenic components and character. C. Screen components of development which detract from visual quality. There is no indication if the existinq trees will remain. In the event that the action is approved it is recommended that existinq trees are retained to the Rreatest extent practicable= 6.3 Protect and restore tidal and freshwater wetlands. Maintain buffers to ensure that adverse effects of adjacent or nearby development are avoided: 1. Maintain buffers to achieve a high filtration efficiency of surface runoff. 2. Avoid permanent or unnecessary disturbance within buffer areas. 3. Maintain existing indigenous vegetation within buffer areas. It is further recommended that the Board require a natural veqetated buffer be,qinnin,q at the ed.qe of wetland line landward for a minimum width of 15' (on the affected lot). A sample definition follows: NATURAL VEGETATED BUFFER -- A land area of a certain lenqth and width where existinq veqetation occurs prior to the commencement of any qradinq or clearinq activity. Ve.qetation shall be maintained to achieve a minimum percentaqe of .qround cover of 95%. To achieve the pementaqe of .qround cover, indi.qenous, dmuRht-tolerant ve.qetation shall be planted. Survival of planted veRetation shall be 90% for a period of three years. Maintenance activities within the buffer are limited to removinq ve.qetation which is hazardous to life and property, trimminq tree limbs up to a heiqht of 15 feet tn maintain viewsheds, replantinq of ve.qetation and establishinq a four-foot-wide access path constructed of pervious material for access to the water-body. INSTRUCTIONS All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area.
