SCTM#1000-126-11-22 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LVVRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action to building permit for demolition and construction of a new single family dwelling at: 1 ) less than the code required setback of 75 feet from a bulkhead is CONSISTENT with the LWRP. The proposed less than the code required single side yard setback of 15 feet, and less than the code required combined side yard setback of 35 feet is EXEMPT from LWRP review pursuant to § 268-3. Definitions. MINOR ACTIONS item "F", which states: F. Granting of individual setback, lot line and lot area variances, except in relation to a regulated natural feature or a bulkhead or other shoreline defense structure or any activity within the CEHA; Figure 1. Subject parcel. q'he side yard variance requested will not affect a regulated natural feature and the parcel is not located within the Coastal Erosion Hazard Area. Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Therefore, in accordance w/th the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661) no permit is required under the Tidal Wetlands Act. Please be advised, howevex, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction which may result from your project.
