Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Jill Doherty, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: November 14, 2011 Re; Proposed Wetland Permit for LAUREL HILL LIMITED PARTNERSHIP SCTM# 1000-145-4-18 En-Consultants on behalf of LAUREL HILL LIMITED PARTNERSHIP requests a Wetland Permit to construct approx. 73 If. of vinyl bulkhead in place of existing timber bulkhead; construct +/-9' vinyl return in place of existing northeasterly return; construct +/-12' vinyl return along southwesterly property line; and backfill with up to 10 cy. clean sand to be trucked in from an upland source; and establish a 5' non- turf buffer behind bulkhead. Located: 350 MacDonald's Crossing, Laurel. SCTM#145-4-18 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is EXEMPT from LWRP review pursuant to: § 268-3. Definitions. MINOR ACTIONS item "B" which states: Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading buildings to meet building or fire codes, except for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed without a permit; The proposed action is not located within the CEHA. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria ~ Yes [~ No ~] Not Applicable The existing, developed site has been improved with and supported and protected from flooding and erosion by a bulkhead at the toe of the embankment since prior to 1977, and the project seeks to maintain this existing condition through the ordinary and routine in-place replacement of the bulkhead. There is no viable non-structural alternative means of maintaining and protecting the vegetated embankment and upland portion of the parcel in its current location. Therefore, the project is consistent with Policy 4 to the extent this policy can be applied to the in-place replacement of an existing bulkhead. Attach additional sheets if necessary Policy 5.
