Proper-T Permit Services on behalf of SALT LAKE ASSOCIATION, INC. requests a Wetland Permit to
maintenance dredge portions of boat basin to 5' below mean Iow water; place dredge spoil at approved
location. Maintenance dredge to same conditions as necessary at maximum of four (4) additional
events during the next ten (10) years. Located: Old Salt Rd., Mattituck. SCTM#144-5-19
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that
the Board considers the following best management practice:
It is recommended that the Board verify when the last maintenance dredRin.q event took place in
this location to determine if the action meets the definition of MAINTENANCE DREDGING
defined as - A dred.qin~l project will be considered maintenance dred.qin.q if there
documentary evidence that it has been previously dred.qed.
In the event that the action is approved:
§ 275-11. Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of the
Trustees:
(2) Erosion control. Installation of an erosion control structure is necessary during any
building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may
include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt
booms. The placement of the erosion control structure(s) shall be determined by the Trustees or
their designee. All intertidal construction and excavation requires the installation of a silt
boom that will retain all suspended sediments within the immediate proiect area_
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

Policy l~Fo~r a~attern of development in the Town of Sonthold that enhances com-
munity character, preserves open space, makes efficient use of infrastructure,
makes beneficial use of a coastal location, and minimizes adverse effects of
development.

The maintenance dredging of a portion of an existing boat basin is not inconsistent
with the character of the waterfront community, and because there are no plans to
increase the development of the relatively small area it is felt that there is no ed-
verse impact on the desired preservation of open space. Infrastructure use is not a
factor since the project is to maintain an existing facility. The project is certainly
beneficial in supporting and maintaining an existing use of the coastal location,
without any incremental increase in development in the area.

There is no evidence to indicate that the immediate area of the project includes his-
toric features, and it is to be expected that the mainly intertidal nature of the project
area is unlikely to have been the site of activities of past civilizations.
Policy 3 Enhance visual quality and protect scenic resources throughout the Town of
Southold.

The maintenance dredging does not involve changes to or the addition of any
above-ground or above-water structures and upon its completion its effects will not
be visible either from land or from the water. It is compatible with other existing
shoreline structures and activities in the area, and will not adversely affect the dy-
namic landscape elements (tidal fluctuations, seasonal vegetation changes; sea-
sonai/diumal changes in ambient light) which might contribute to ephemeral visual
qualities.

It is intuitively obvious that the likelihood of the activity proposed contributing to
increased hazards which could result in the losses listed is minimal. Natural protec-
tive features will not be adversely affected

The proposed project does not include any activity which will have a long-term
adverse effect on water quality and supply. During the dredging operation, the
bottom within the basin will, of course, be disturbed and turbidity will result, but
experience indicates that this will be self-correcting within a short period. Liquid
or solid wastes will not be discharged into the water or wetlands before, during, or
after the dredging..

The area to be dredged is completely devoid of wetland vegetation. During the
dredging, the indigenous plants in adjacent areas will be protected insofar as possi-
ble. The project is not located in a Significant Coastal Fish and Wildlife Habitat,
but the nature of the project, considering that it is the maintenance of an existing
approved docking area, is such that there will be no new impacts on any of the sort
of resources listed in the NYSDOS narratives for similar locations. All statutory
and regulatory requirements, at all levels of government, will be strictly complied
with. No excavating or filling is proposed.
Policy 7 Protect and improve air quality in the Town of Southold.

The dredging or the use of the dredged boat basin as proposed will not result in
significant amounts of new air pollution. The purpose of the dredging is to allow
the unimpeded use of the existing docking facilities.

solid waste. The handling and storage of petroleum products both during the

proved containers and facilities, and approved methods of handling and storage

The planning and implementation of the project are, and will be, such that energy
efficient design criteria are applied throughout, based upon any local or State
building codes, or upon practices generally recognized as desirable in this regard.
As has been stated, any handling and storage of petroleum products will be
complished through the use of containers, facilities and methods of handling and
storage as approved for commercial dredging activities and which are generally
accepted as safe. Upland site drainage and water control will not be a factor. As
has been noted, spoil resulting fi.om the dredging will be removed to a site at
which it will pose no environmental burden.
