Proper-T Permit Services on behalf of KEVlN LATULIP requests a Wetland Permit to spot
repair as necessary the existing timber sheathing of 100 If. of bulkhead; add vinyl sheathing
and filter cloth on landward side of existing bulkhead and repair, replace, or add deadmen as
needed landward of existing bulkhead; place estimated 110 cy. of clean sand fill in washout

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the LWRP review provided
the following best management practices are required if the action is approved:
To further Policy 5: Protect and Improve Water Quality in the Town of Southold and Po/icy 6;
Protect and Restore the Quality and Function of the Town of Southo/d Ecosystem it is
recommended that the Board require a silt boom during construction.
§ 275-11. Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of
the Trustees:

Erosion control. Installation of an erosion control structure is necessary during any
building, grading, landscaping or site work activity within Trustee jurisdiction. This
structure may include, but is not limited to, installation of a silt fence, hay bales,
wood chip berm and silt booms. The placement of the erosion control structure(s)
shall be determined by the Trustees or their designee. All intertidal construction
and excavation requires the installation of a silt boom that will retain all
suspended sediments within the immediate project area.
In addition it is recommended that the Board require the establishment of a landscaped
buffer on filled areas landward of the replaced bulkhead. A sample definition is provided
below.
LANDSCAPED BUFFER -- A land area of a certain length and width which is planted with indigenous,
drought-tolerant vegetation similar to that found within the immediate proximity of the parcel. Vegetation
shall be installed in sufficient densities to achieve 95% ground cover within two years of installation.
.Survival of planted vegetation shall be 90% for a period of three years. Maintenance activities within the
buffer are limited to removing vegetation which is hazardous to life and property, trimming tree limbs up
to a height of 15 feet to maintain viewsheds, replanting of vegetation and establishing a four-foot-wide
access path constructed of pervious material for access to the water body. [Added 12-15-2009 by L.L.

Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

Foster a pattern of development in the Town of Southold that enhances com-
munity character, preserves open space, makes efficient use of infrastructure,
makes beneficial use of a coastal location, and minimizes adverse effects of
development.

The repair and strengthening of an existing bulkhead is not inconsistent with the
character of the waterfront community, and because of the relatively small foot-
print of the existing bulkhead it is felt that there is no adverse impact on the desired
preservation of open space. Infrastructure use is not a factor since the project is ac-
cessory to and accessed from private property. The maintenance of the erosion
control purpose of the bulkhead is certainly a beneficial use of the coastal location,
and there is no incremental increase in development in the area since the bulkhead
already exists in the same form as it will have after completion of the project.

There is no evidence to indicate that the immediate area of the project includes his-
toric features, and it is to be expected that the mainly intertidal nature of the project

The bulkhead repair and strengthening will be done in such a manner that upon
completion of the project the will be no apparent change in the project site, since
the added construction components will be completely underground. The existing
bulkhead, which will retain its current form, is compatible with other existing
shoreline structures in the area, and will not adversely affect dynamic landscape
elements (tidal fluctuations, seasonal vegetation changes; seasonal/diurnal changes
in ambient light) which might contribute to ephemeral visual qualifies.

It is intuitively obvious that the likelihood of the activities proposed contributing to
increased hazards which could result in the loss of life from flooding or erosion is
probably non-existent. The proposed bulkhead repair and strengthening will have
a significant positive effect on the protection of structures and natural resources
from flooding and erosion in that the existing bulkhead, which currently provides
those features, is tending toward failure and its repair is required in order that these
protective features continue in effect.

will have no direct effect upon the Town's ecosystem, however that may be de-
fined. The project will have no adverse effect upon existing tidal patterns and there
will be no degradation of water quality.
All statutory and regulatory requirements, at all levels of government, will be
strictly complied with. No dredging, excavating, or filling in wetlands is included
in the project.
