SCTM#1000-110-7-4 Bulkhead Permits by Gary, Inc. on behalf of LEONARD RIDINI requests a Wetland Permit to replace the existing 135'+/- navy style bulkhead in-kind/in-place; replace existing 5' &14' sections of bulkhead; construct new 6' inland vinyl sheathing return; backfill bulkhead with approx. 200 cy. clean fill; replace existing 14'X 36' boardwalk and 30"× 8' timber stairs in-kind/in-place; replace existing 30"X 7' timber stairs in-kind/in-place; and remove/replace existing bathhouse and roof to allow for bulkhead replacement, and repair as needed. Located: 805 West Rd., Cutchogue. SCTM#110-7-4 Figure 1. Subject Parcel. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the to replace the existing 135'+1- navy style bulkhead in-kind/in-place; replace existing 5' &14' sections of bulkhead; construct new 6' inland vinyl sheathing return; backfill bulkhead with approx. 200 cy. clean fill is CONSISTENT with the policies of the LWRP. The replacement of a proposed 14' x 36" square foot inland boardwalk is not a permissible action pursuant to 275-11 Construction and operation standards, A (6) and is INCONSISTENT with LWRP Policy 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the $outhold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. 275-11 Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (6) Decks and platforms. No decks or platforms shall be permitted on or near bluffs. Platforms associated with stairs may not be lar, qer than 32 square feet. [Amended 10-11-2005 by L.L. No. 17-2005] The inland boardwalk is located at the toe of the bluff. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. INSTRUCTIONS All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment i~ intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Souflaold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its .qi..~nifieant beneficial and adverse effects upon the coastal area (which includes all of Southuld Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus~ each answer must be expla,~ed in detail~ iistin~ both supporting and non suooortin[ facts. If an action cannot be certitied as consistent with the LWRP policy standards and conditions, it shall not be undertaken.
