Located: 750 East Mill Rd., Mattituck. SCTM#107-1-1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the is INCONSISTENT with LWRP Policy 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. 275-11 Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: [b] If any part of a residential dock structure includes a float or floating dock, the float or floating dock portion shall be designed so that, with the exception of the pilings: [i] It is no larger than six feet wide and 20 feet long except on Fishers Island if the need is demonstrated; or of equal square footage as determined by the Trustees; [Amended 12-18-2007 by L.L. No. 23-2007] The total square footage of floats equals 281. The maximum floating dock portion of a dock is restricted to 120 square feet. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Cc: Lori Hulse, Assistant Town Attorney APPLICANT: JAMES NEUMANN SCTM #: 1000-107-1-1 LWRP CONSISTENCY ASSESSMENT FORM Policy 1 [] YES Foster a pattern of development in the Town of Southold that enhances com- munity character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. ~NO [] NOT APPLICABLE The addition of a small (approximately 5' x 13') float to provide docking space for a personal watercraft (henceforth, PWC) as an addition to an existing private-usc dock is consistent with the character of the waterfront community, and because of the relatively small area of the proposed float it is felt that there is no adverse im- pact on the desired preservation of open space. Infrastructure use is not a factor since the project is accessory to and accessed from private property. The project is certainly a beneficial use of the coastal location, and the incremental increase in development in the area is insignificant. ~ ~ Policy 2 [] YEs Preserve historic resources of the Town of Southold. [] NOT APPLICABLE There is no evidence to indicate that the immediate area of the project includes his- toric features, and it is to be expected that the mainly intertidal nature of the project area is unlikely to have been the site of recoverable artifacts of past civilizations. Policy 3 [] YEs Enhance visual quality and protect scenic resources throughout the Town of Southold. ~O [] NOT APPLICABLE The structure proposed, and the PWC served, are of low profile and will be incon- spicuous in the proposed location. The addition is compatible with other existing shoreline structures in the area, and will not adversely affect the dynamic land- scape elements (tidal fluctuations, seasonal vegetation changes; seasonal/diurnal changes in ambient light) which might contribute to ephemeral visual qualities. Policy 4 Minimize loss of life, structures, and natural resources from flooding and ero- sion. [] YES ~O [] NOT APPLICABLE It is intuitively obvious that the likelihood of the structure proposed contributing to increased hazards which could result in the losses listed is minimal. Natural protec- tive features will not be adversely affected Policy 5 Protect and improve water quality and supply in the Town of Southold. [] YES ~O [] NOT APPLICABLE The proposed project will not include a pump-out station nor will liquid or solid wastes be discharged into the water or wetlands. There will be no disturbance of the creek bed during construction and thereafter during active use of the structure. Policy 6 [] Protect and restore the quality and function of the Town of Southold's ecosys- tem. ~O [] NOT APPLICABLE Any additional bottom-shading resulting from the project structure will not be a factor, since the bottom in the area to be occupied by the float is bare of vegetation. During construction, nearby indigenous plants will be easily protected since the float will be secured only by hardware to the existing structure. The project is not located within a Significant Coastal Fish and Wildlife Habitat; it is approximately 650 feet distant by a shoreline tie-line 15om the southern boundary of the Mattimck Creek Wetland. All statutory and regulatory requirements, at all levels of govern- ment, will be strictly complied with. No dredging, excavating, or filling is pro- posed. Policy 7 Protect and improve air quality in the Town of Southold. [] Yr s [] nOT APPLICAnL The construction or use of the project as proposed will not result in significant amounts of new air pollution. Policy 8 [] YES Minimize environmental degradation in the Town of Southold from solid waste and hazardous substances and wastes. ~NO [] NOT APPLICABLE The project as proposed will not result in the generation of any additional solid waste. The handling and storage of petroleum products, if any, will be accom- plished through the use of approved containers and facilities, and approved meth- ods of handling and storage will be followed. Policy 9 [] YES Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. Policy 10 [] YEs Protect Southold's water-dependent uses and promote siting of new water- dependent.dus~s in suitable locations. Policy 13 Promote appropriate use and development of energy and mineral resources [] YES ~O [] NOT APPLICABLE The planning and construction of the project is, and will be, such that energy effi- cient design criteria are applied throughout, based upon any local or State building codes, or upon practices generally recognized as desirable in this regard. As has been stated, any handling and storage of petroleum products will be accomplished through the use of containers, facilities and methods of handling and storage as approved for residential property use and generally accepted as safe.
