SCTM#1000-87-5.20 Proper-T Permit Services on behalf of COVE CONDOMINIUMS OWNERS ASSOC. requests a Wetland Permit to maintenance dredge to 3' below mean Iow water approx. 82 cy. from channel at entrance to Association docking area as needed, within the docking area itself; dredge as necessary in the same areas to maintain width, depth and full accessibility of entrance channel and docking area on a maximum of four additional occasions during the next ten (10) yearn. Spoil will be removed to an approved upland location for deposition. Located: Main Bayview Rd., Southold. SCTM#87-5-20 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that with the LWRP provided that the Board considers the following best management practice: § 275-11. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area, Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. SCTM #: 1000-87-5-26 LWRP CONSISTENCY ASSESSMENT FORM Policy 1 [] YES Foster a pattern of development in the Town of Southold that enhances com- munity character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. ~NO [] NOT APPLICABLE The maintenance dredging of a portion of an existing boat basin is not inconsistent with the character of the waterfront community, and because there are no plans to increase the development oftbe relatively small area it is felt that there is no ad- verse impact on the desired preservation of open space. Infrastructure use is not a factor since the project is to maintain an existing facility. The project is certainly beneficial in supporting and maintaining an existing use of the coastal location, without any incremental increase in development in the area. Policy 2 Preserve historic resources of the Town of Southold. [] YEs [] NOT APPLICABLE There is no evidence to indicate that the immediate area of the project includes his- toric features, and it is to be expected that the mainly intertidal nature of the project area is unlikely to have been the site of activities of past civilizations. Policy 3 [] YEs Enhance visual quality and protect scenic resources throughout the Town of Southold. ~NO [] NOT APPLICABLE The maintenance dredging does not involve changes to or the addition of any above-ground or above-water structures and upon its completion its effects will not be visible either t~om land or from the water. It is compatible with other existing shoreline structures and activities in the area, and will not adversely affect the dy- namic landscape elements (tidal fluctuations, seasonal vegetation changes; sea- sonal/diurnal changes in ambient light) which might contribute to ephemeral visual qualities. Policy 4 [] YES Minimize loss of life, structures, and natural resources from flooding and ero- sion. ~NO [] NOT APPLICABLE It is intuitively obvious that the likelihood of the activity proposed contributing to increased hazards which could result in the losses listed is minimal. Natural protec- tive features will not be adversely affected Policy 5 Protect and improve water quality and supply in the Town of Southold. [] YES 1~O [] NOT APPLICABLE The proposed project does not include any activity which will have a long-term adverse effect on water quality and supply. During the dredging operation, the bottom within the basin will, of course, be disturbed and turbidity will result, but experience indicates that this will be self-correcting within a short period. Liquid or solid wastes will not be discharged into the water or wetlands before, during, or after the dredging.. Policy 6 Protect and restore the quality and function of the Town of Southold's ecosys- tem. [] YES ~NO [] NOT APPLICABLE The area to be dredged is completely devoid of wetland vegetation. During the dredging, the indigenous plants in adjacent areas will be protected insofar as possi- ble. The project is located in the Corey Creek Significant Coastal Fish and Wildlife Habitat, but the nature of the project, considering that it is the maintenance dredg- ing of an existing approved docking area, is such that there will be no new impacts on any of the resources listed in the NYSDOS narrative as revised in 2002. All statutory and regulatory requirements, at all levels of government, will be strictly complied with. Policy 7 [] YES Protect and improve air quality in the Town of Southold. ~O [] NOT APPLICABLE The dredging or the use of the dredged boat basin as proposed will not result in significant amounts of new air pollution. The purpose of the dredging is to allow the unimpeded use of the existing docking facilities. Policy 8 Minimize environmental degradation in the Town of Southold from solid waste and hazardous substances and wastes. The handling and storage of petroleum products both during the dredging and upon its completion will be accomplished through the use of ap- proved containers and facilities, and approved methods of handling and storage will be followed. As has been stated, any handling and storage of petroleum products will be ac- complished through the use of containers, facilities and methods of handling and storage as approved for commercial dredging activities in environmentally sensi- tive areas and which are generally accepted as safe. Upland site drainage and water control will not be a factor. As has been noted, spoil resulting from the dredging will be removed to a site at which it will pose no environmental burden.
