Proper-T Permit Services on behalf of FERUCIO FRANKOLA requests a
Wetland Permit to replace in-place existing wood bulkhead 118' with new wood
bulkhead 6" higher than existing bulkhead, to include fender piles, sheathing,
wales, tie-rods, backer piles and lay logs. Excavate as necessary to add a total of
244' of vinyl sheathing on the landward side of the existing wood bulkhead;
repair, replace or add anchor structures as necessary. Provide 10' non-turf
buffers behind each bulkhead. Dredge as necessary within 10' seaward of
bulkheads to recover spillage from construction. Located: 1900 Glenn Rd.,
Southold. SCTM#78-2-35
The actions have been reviewed and my recommendation is that the proposed
actions are CONSISTENT with the Local Waterfront Revitalization Program
provided the following best management practices (or similar) are required:
1. Require the following storm water control improvements are employed if
the action is approved.
a. A total maximum daily load reduction (71% reduction of pathogens)
has been established for Goose Creek. It is strongly recommended
to further Policy 5 and 6 of the LWRP that corrugated plastic pipe
(point source discharge) that drains storm water into the water body
be addressed. The pipe and associated catch basin were installed
during subdivision build out in the 1960's. In discussion with Jamie
Richter, Office of the Town Engineer, he recommended that the
pipe be left in place. However, I recommend that the Board
coordinate with Mr. Richter to review the proposed actions and
investiqate the redirection of storm water runoff to Grissom Road (A
50' wide paper road created during the subdivision in 1963). The
tax map indicates that Grissom Road is owned by the Town. Mr.
Richter is out of the office and unavailable to comment at this time.

b. Further is recommended that a trench drain be required to be
installed to capture storm water runoff from the boat ramp.
c. Require turbidity controls during dredging of the basin.
The pamels are zoned Residential-40 (R-40). A more complicated issue is the
Marina use in a R-40 zoning district. The boat basin existed and is referenced
on the subdivision plat in 1963, however, there is not indication of public use
during that time. It is recommended that the Board determine the use and
legality of such use in the zone.

Foster a pattern of development in the Town of Southold that enhances com-
munity character, preserves open space, makes efficient use of infrastructure,
makes beneficial use of a coastal location, and minimizes adverse effects of
development.

The repair and strengthening of existing Bulkhead A, and the in-place replacement
of Bulkhead B are not inconsistent with the character of the waterfront community,
and because of the relatively small footprint of the existing bulkheads it is felt that
there is no adverse impact on the desired preservation of open space. Infrastructure
use is not a factor since the project is accessory to and accessed from private prop-
erty. The maintenance of the erosion control purpose of the bulkhead is certainly a
beneficial use of the coastal location, and there is no incremental increase in devel-
opment in the area since the bulkheads already exist in the same form as they will
have after completion of the project.

There is no evidence to indicate that the mediate area of the project includes his-
toric features, and it is to be expected that the mainly intertidal nature of the project
area is unlikely to have been the site of recoverable artifacts of past civilizations.

Southold.

The bulkhead repair and strengthening, and the bulkhead replacement, will be done
in such a manner that upon completion of the project the will be no apparent
change in the project site with regard to the structures. At completion the bulk-
heads which will retain their current forms, are compatible with other existing

shoreline structures in the area, and will not adversely affect dynamic landscape
elements (tidal fluctuations, seasonal vegetation changes; seasonal/diurnal changes
in ambient light) which might contribute to ephemeral visual qualities.

It is intuitively obvious that the likelihood of the activities proposed contributing to
increased hazards which could result in the loss of life from flooding or erosion is
probably non-existent. The proposed project will have a significant positive effect
on the protection of structures and natural resources fxom flooding and erosion in
that the existing bulkheads, which currently provide those features, are tending to-
ward failure and their repair/replacement is required in order that these protective
features continue in effect.

The project presumably will extend the useful life of the bulkheads and hence de-
lay the time when the bulkheads will fall, and therefore delay the time at which ei-
ther of those eventualities will generate some degree of impact upon the Town's
ecosystem. In the meantime, the project of itself will have no direct effect upon the
Town's ecosystem, however that may be defined. The project will have no adverse
effect upon existing tidal patterns and there will be no degradation of water quality.
All statutory and regulatory requirements, at all levels of government, will be
strictly complied with. Minimal dredging is proposed to recover material lost into
the waterway during construction.
