En-Consultants on behalf of HENRY & SUSAN RUGGIERO requests a Wetland Permit to
construct approx. 166 If. of vinyl bulkhead, +/-11' westerly vinyl return, and +/- 28' vinyl return
in place of (and 12" higher than) existing timber bulkhead and returns; and backfill with approx.
50 cy. clean sand/topsoil to be trucked in from an upland source. Located: 425 Calves Neck
Rd:, Southold. SCTM#63-7-29.1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of $outhold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the LWRP review provided
the following best management practices are required if the action is approved:
To further Po#cy 5: Protect and Improve Water Quality in the Town of Southold and Policy 6;
Protect and Restore the Quality and Function of the Town of Southold Ecosystem it is
recommended that the Board require a silt boom during construction.
§ 275-11. Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of
the Trustees:

Erosion control. Installation of an erosion control structure is necessary during any
building, grading, landscaping or site work activity within Trustee jurisdiction. This
structure may include, but is not limited to, installation of a silt fence, hay bales,
wood chip berm and silt booms. The placement of the erosion control structure(s)
shall be determined by the Trustees or their designee. All intertidal construction
and excavation requires the installation of a silt boom that will retain all
suspended sediments within the immediate project area.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

Approximately 50 cubic yards clean sand/soil backfill will be trucked in from an upland source and used to backfill and
raise the grade 12" landward of the new bulkhead.

The project entails the ordinary and routine maintenance of an existing shoreline structure, specifically the in-place replacement of
an existing wood bulkhead with a vinyl bulkhead. The grade behind the bulkhead will be raised 12 inches, which will lessen the
slope and thus the potential rate and volume of surface water runoff moving toward the bulkhead; and a previously required 20'
wide nonturf buffer will be established and maintained behind the bulkhead upon project completion. Therefore, the project will
not have any significant adverse impacts on the adjacent tidal wetlands or waters of the Town.
