Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Jill Doherty, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: October 11, 2011 Re: Proposed Wetland Permit for ARTHUR & AUDREY UELAND SCTM# 1000-51-4-14,15.2 Costello Marine Contracting Corp. on behalf of ARTHUR & AUDREY UELAND requests a Wetland Permit and Coastal Erosion Permit to remove remaining existing face pilings; construct 90' of new sheet sheathed bulkhead in front of existing T&G bulkhead; install 2.5 to 3 ton rock armoring at base of new bulkhead; fill void area east of stairway with 95 cy. of clean trucked in sand; re-vegetate disturbed areas with Cape American beach grass; extend lower platform as required and install new 3' aluminum stairway to beach. Located: 20845 Soundview Ave., Southold. SCTM#51-4-14,15.2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP review provided the following best management practices are required if the action is approved: To further Policy 5: Protect and Improve Water Quality in the Town of Southold and Policy 6; Protect and Restore the Quality and Function of the Town of Southold Ecosystem it is recommended that the Board require a silt boom during construction. § 275-11. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of ~ silt boom that will retain all suspended sediments within the immediate project area. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. INSTRUCTIONS All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes", then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. A copy of the LWRP is available in the following places: online at the Town of Southold's website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Depar'anent, all local libraries and the Town Clerk's office. Our proposal is an attempt of the upland property owner to maintain their property. The bulkhead is needed to support the toe o£ the bfuff to prevent slumping and to maintain the upland properfy. The present condition of the bluff area is poor and unsafe. These conditions are limiting the property owners' ablllO, to access the water. This property is used to engage in water-dependent activities such as fishing and swimruing. These activities will continue at the site once construction is complete.
