Strouse, L.S., dated June 9, 2009; and WHEREAS, on March 15, 2010, during a Planning Board Work Sess on, the' application was formally accepted for review; and ' WHEREAS, on March 16, 2010, the Southold Town Planning Board distributed the application to agencies having jurisdiction for their comments, and the following CMEEC, Fishers Island PaRe Two June 15, 2010 agencies responded: Town Engineer, ^mhitectural Review Committee, and the Southold Town Board of Trustees; and WHEREAS, the comments from those agencies referenced above were received and accepted by the Planning Board, discussed with the applicant, and incorporated into the site plan to the satisfaction of the Planning Board; and WHEREAS, on March 16, 2010, the Southold Town Planning Board, pursuant to Southold Town Code {}280-131 C., distributed the application to the Suffolk County Planning Commission; and WHEREAS, on March 26, 2010, comments were received by the Suffolk County Planning Commission and the site plan was determined to be a matter of local determination; and WHEREAS, on March 30, 2010, the Town of Southold LWRP Coordinator reviewed the above-referenced project and had recommended the proposed project to be consistent with Southold Town LWRP policies; and WHEREAS, on April 12, 2010, a public hearing was held and closed; and WHEREAS, on May 4, 2010, the applicant submitted a Storm Water Run-off Analysis in connection with the site plan and it was forwarded to the Town Engineer for comment; and WHEREAS, on May 7, 2010, the Town Engineer concluded that the drainage calculations and subsequent drainage design meets or exceeds the requirements of the Town Code Chapter 236 Storm Water Management; and WHEREAS, on May 12, 2010, comments were sent by the Planning Board to the Zoning Board of Appeals in support of the special exception use; and WHEREAS, on June 10, 2010, the Southold Town Zoning Board of Appeals granted a Special Exception for the proposed use; and WHEREAS, on June 11, 2010, the Southold Town Building Inspector reviewed the plan and certified that the proposed use is a permitted use in this Business Zoning District; therefore, be it RESOLVED, that the Southold Town Planning Board has determined that the action is consistent under the policies of the Town of Southold Local Waterfront Revitalization Program in a memo prepared by the LWRP Coordinator; and be it further RESOLVED, that the Southold Town Planning Board grants Approval with a Condition, and authorizes the Chairman to endorse the site plan entitled "The Fishers Island Electric Corporation", prepared by Richard H. A Landscape Plan will need to be coordinated with the Planning Board designee and submitted to the Planning Board prior to a Certificate of Occupancy being issued for the approved site plan application. Please also note the following requirements in the Southold Town Code relating to site plans: 1. Any outdoor lighting shall be shielded so the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. 2. A{I storm water run-off from grading, driveways and gravel areas must be contained on site. 3. Approved site plans are valid for three years from the date of approval, within which time all proposed work must be completed, unless the Planning Board grants an extension. 4. Any changes from the approved site plan shall require Planning Board approval. 5. Prior to the issuance of a Certificate of Occupancy, the Planning Board, or its representative, must inspect the site to ensure it is in conformity with the approved site plan and issue a final site inspection approval letter. Should the site be found not in conformance with the approved site plan, no Certificate of Occupancy may be issued unless the Planning Board approves the changes to the plan. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: F1N'D1NGS OF FACT In considering this application, the Board has reviewed the code requirements set forth pursuant to Article XI, Section 280-47(B)(1) to establish a Public utility emergency generator and finds that the applicant complies with the requirements for the reasons noted below: This unit on Fishers Island is being installed in conjunction with Groton Utilities (the municipal entity that supplies electric power to Fishers Island). The Facility is planned to be located on land leased from Fishers Island Electric Utility. Fishers Island has no municipal generation source. Connecticut Municipal Electric Energy Cooperative, (CMEEC), proposed this project to reduce peak demand power supply costs and as an added benefit to provided back up emergency power within their local distribution grids during a natural or man made event causing interruption of power. Accordingly, the structures comprising the project proposed by CMEEC are "public utility ... structures and other installation" as referenced in Town Code Sections 280-13B(6) and 280-48(B)(1) (incorporating by reference Section 280-13B(2)-(12)). REASONS FOR BOARD ACTION DESCRIBED BELOW: Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: 1) The granting of this special exception will be in harmony with the intent and purpose of the zoning ordinance. The public utility use is an allowable use within the B-zoning district by Special Exception. The use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts. It will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the proposed use is to be located or of permitted or legally established uses in adjacent use districts. 2) The public utility use herein conforms to the standards prescribed in the ordinance. The property upon which the generator will be placed has a history dating back to the 1940's of being used for the purpose of supplying Fishers Island sole source of electricity. This use includes generating, distributing and maintaining the equipment necessary to support the operational responsibility of a public utility. 3) The public utility use of this property is not detrimental to property or persons in the neighborhood for the following reasons: A) The new generator will have the most up to date equipment installed to control and reduce harmful emissions, it will meet all State regulations. B) The new generator will be housed in a modem sound reducing compartment, which greatly reduces the noise impact and appearance on the surrounding neighborhood when compared to the generator that was removed. C) To meet the minimum national standard of safety, the Board is also granting the requested variance from the height restriction in Town Code 280-105B for an 8 foot high chain link fence topped with barbed wire. This fence, along with other safety devices such as surveillance cameras and locks on the generator compartment, will greatly improve the security and safety when compared to what has existed in the past. D) The safety, the health, the welfare, the comfort, the convenience or the order of the Town will not be adversely affected by the proposed use and its location. E) The use will be in harmony with and promote the general purposes and intent of this chapter. This condition should in no way be considered a restriction on the use of this facility by the FIEC for power generating purposes and during emergency situations. 5. The total height of the security fence surrounding the new generating facility shall be no higher than 8 feet including the barbed wire. Any deviation from the survey, site plan and/or amhitectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The analysis was conducted by our environmental engineering support contractor, TRC, of Windsor, CT. The report and its recommendations and conclusions have been reviewed and approved by CMEEC. Copies of this analysis are enclosed. The study shows that addition of a dry well on the down slope edge of the site will alleviate the runoff conditions currently being experienced. Please pass a copy of the report to Mr. Richter for his review. We request that you inform the Planning Board that CMEEC will carry out the recommendation of Paragraph 4.1 of the referenced report during the project site construction. We will install an 8 foot by 3 to 4 foot pre-cast concrete dry well. The dry well will be field located, approximately as shown in the attached report and will be indicated on the as-built drawings prepared for the project. Thank you. £0/[0 3D~d D33ND 8~[BBBBOg8 6[:~ Attachment B: PROJECT DESCRIPTION Building Permit Application 3/1/10 The Connecticut Municipal Electric Energy Cooperative (CMEEC), a state-chartered municipal energy cooperative organized pursuant to Chapter 10la of the Connecticut General Statutes, seeks to install and operate one 2.5 mW diesel electric generating unit and ancillary equipment on property leased from Fishers Island Electric Corporation (FIEC) located at 1866 Central Avenue, Fishers Island. (Attachment s A, C & D) The unit on Fishers Island is being installed in conjunction with Groton Utilities (the municipal entity that supplies electric power to Fishers lsland) as part of CMEEC's "50 in 5" program. Groton Utilities is a member of the CMEEC municipal energy cooperative. The proposed Fishers Island generator is one of 20 identical such units; the other 19 being installed at various sites in southeastern CT. These generating units are intended for the benefit of CMEEC's participant municipal electric utilities to reduce peak-demand power supply costs. As an added benefit, they will provide back-up emergency power within their local distribution grids during a natural or man-made event causing interruption of power. The emergency power aspect of this project is especially important to the citizens of Fishers Island. Fishers lsland Electric Corporation is also a member of Connecticut Municipal Electric Energy Cooperative. Although a Generator Operator registered with the U.S. Department of Energy, F IEC currently has no municipal generation source. It has no electrical connection to any source of electric power from within the State of NY. lts electric power is supplied by underwater cables from Groton Utilities, Groton, CT. The proposed unit will be available to provide vital emergency power in event of disruption of electric service to Fishers Island from Groton. At 2.5 mW, the unit will be capable of meeting the entire electric load demand of the Island. Of all our sites, Fishers Island will benefit most in this regard. The proposed site in the FIEC utility yard was chosen because it is an industrial location at a substation where electric power generation has been conducted since the early 1940's. The last of the old generators was removed from the site in January 2009. F1EC retains its registration as a Generator Operator with the US Department of Energy at the existing site at 1866 Central Ave, as U. S. DOE Electric Generator Operator ID: 6369. This registration expires 12/31/10 (it will be renewed). By any measure, this site is an ideal interconnection point for the proposed new generator. (Attachment G) By its nature, the substation site is currently used for municipal electrical equipment; hence the installation of the new generator here will cause no change in the natare or use of the location. The facility will be normally unmanned, monitored and controlled remotely. There will be no adverse impact on parking or traffic flow at the site. The unit is equipped with emissions control provided by a best-available-technology selective catalytic reduction (SCR) system and diesel particulate filters. Together, these are designed to reduce both particulate matter and NOx emissions. (Attachments C, H and K) The Fishers Island unit will operate for a few hours during late afternoon hours a few days per week during the year. Total run time is expected to be about 300 hours per year, distributed within each month with proportionally more run time during peak demand in winter and summer months. The Generator Enclosure has been specially designed to be very quiet, <65 dB at 50feet. 65 dB is a background noise level at which ordinary conservation can be conducted without raising the voice. (Attachment K) Several permitting actions regarding the planned installation of the unit on Fishers Island have been taken: -- An application for an air emissions permit (Application ID: 1-4738-03923/00001) was submitted to the NY DEC in August 2009. The DEC review has been completed satisfactorily. The DEC issued a Tentative Determination to Approve on January 11, 2010. The DEC has advertised in the Suffolk Times for public comment on the project. The period for public comment closed on February 19, 2010 with no adverse comments. This application is in the final stages of approval. The DEC contact person is Ms. Kendall P. Klett; phone 631-444-0363. -- The New York State Department of Environmental Conservation, as Lead Agency, issued a finding on January 11,2010, that the proposed project will not result in any adverse environmental impact and that a draft Environmental Impact Statement will not be prepared. In its review, the DEP considered many aspects of the project, including: air pollution emissions; water quality; noise levels; traffic; erosion; drainage patterns; endangered species and migratory pathways; critical environmental areas; consistency with existing use and intensity of the land; disturbance of natural, aesthetic or cultural resources; energy usage and generation of solid waste; and any long-term or cumulative impacts of the project. In each case no adverse effects were noted or anticipated. The DEC contact person is Ms. Kendall P. Klett; phone 631- 444-0363. (Attachment E) -- The New York State Department of Environmental Conservation determined on January 11 2010 that the State Environmental quality Review (SEQRA) status of the proposed project was "Unlisted Action" and a Negative Declaration Notice of Determination of Non-Siqnificance was issued (#1-4378-03923/00001). The DEC contact person is Ms. Kendall P. Klett; phone 631-444-0363. (Attachment E) -- An Application for Permit to construct a Toxic/Hazardous Materials Storage Facility was submitted to the Suffolk County Department of Health Services on January 19, 2010. This application (M-2291) is under review. The Department of Health contact person is Mr. Kenneth A. Clunie; phone 631-854-2528. The hazmat materials facility consists off (1) the diesel generator 4.200 gallon main fuel tank, (2) a 150 gallon diesel fuel day tank within the engine's fuel delivery system and (3) a 1550 gallon urea storage tank. The chemicals associated with the generator are common, relatively benign, substances in widespread industrial and public use: ultra low sulfur diesel fuel, propylene glycol anti-freeze, 40% urea solution, and 15 W-40 lubrication oil. 40% Urea is used within the selective catalytic reduction system as part of the NOx control technology. Our submittal to Suffolk County addressed tank construction, level and leak detection instrumentation, alarms, piping, fittings, overfill protection, spill prevention and spill mitigation. Ihis permit application is under review with no adverse considerations noted to date. -- Flood zones were considered. The survey conducted in mid-2009 has been updated to show the new (Sept 2009) flood zone mapping. The project remains above the 100 year flood zone under the new mapping. A copy of the updated survey is attached. (Attachment D) The first five identical units are currently being installed and commissioned on three sites (two are on dual-unit sites) in Connecticut. Each unit has received emissions permitting approval from the CT DEP and all local permits have been approved without unusual conditions or exceptions. CMEEC would gladly host a tour of these sites for any Town of Southold officials desiring to see the installation first-hand and form personal assessments on the potential impact on the local community. The Fishers Island unit is the same as a unit currently operating in an identical service profile in the middle of downtown Jewett City, CT with no adverse public comment of any kind. (Attachment H) The Fishers Island unit will be sited entirely within and on a very small portion (993 fi 2/47,441 fi 2) of an existing utility industrial area. The 993 fi 2 footprint of the site construction: comprised of three separate concrete pads to support the generator, the urea tank and a small station service transformer will have no deleterious effect on water runoff. A security fence around the pads expands the area in use to about 3,050 fl. 2. The 6" of crushed stone to be 2 placed around the concrete pads within the security fence will have a beneficial effect in retaining and directing storm water runoff. (Attachments C and F) Although it is visually appealing, this installation will not be readily seen by the public. It is screened by a bluffand trees/shrubs to the north and west, a large electric utility building to the south and east and trees and shrubs to the north. It can be seen behind the utility building from a northeast vantage point. (Attachments C, D and G) CMEEC plans to use the same construction team (Matrix Power Services, Inc.) that is currently involved in the other 19 units. All electrical work will be done by, or under supervision of, Groton Utilities or the generator manufacturer, Cummins Power Systems. Nearly all construction materials will be brought by ferry from New London, CT. No material will be removed from the site. There is no plumbing associated with this project. Oar construction and installation planning derives from experience in several nearly identical sites in Connecticut. (Appendix K) In summary, this is an environmentally benign project, located in an existing elec~ical utility area having the same historical use profile. It will have several design features that will mitigate it effect on the surrounding environment. It is visually attractive. Most of all, it is in the interest of the citizens of Fishers Island by providing infrastructure that will produce both peak shaving economic advantages and vitally needed emergency back-up electric service. Larocca CASE 10-E-0281 - Petition of Connecticut Municipal Electric Energy Cooperative for a Certificate of Public Convenience and Necessity for Construction and Operation of a 2.5 Megawatt Packaged Electric Diesel-Generator. ORDER GRANTING A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY (Issued and Effective August 23, 2010) INTRODUCTION In a petition dated June 9, 2010, the Connecticut Municipal Electric Energy Cooperative (CMEEC or Petitioner) requests a Certificate of Public Convenience and Necessity (CPCN) pursuant to Public Service Law (PSL) §68 for its construction and operation of a 2.5 MW electric diesel generator to be installed within the existing utility yard of the Fishers Island Electric Corporation (FIEC) .~ In its petition, pursuant to CMEEC further requests that the Commission acknowledge that its authority over utility financings pursuant to PSL §69 does not extend to CMEEC and requests lightened and incidental regulation. This requires a notice and comment period as provided for in the State Administrative Procedures Act (SAPA) §202(1) (a). The SAPA comment period expires September 18, 2010. When the comment period has run, we will address in a separate Order, the request for lightened and incidental regulation. CASE 10-E-0281 16 NYCRR 21.10, CMEEC requests expedited treatment of its request that a CPCN be issued to construct and operate the proposed generator, to ensure an adequate supply of electric power on Fishers Island during the peak summer load period. Petitioner has provided evidence of newspaper publication as required pursuant to 16 NYCRR 21.10. No objections have been filed with the secretary within 10 days following such publication. BACKGROUND FIEC is a municipal electric corporation that supplies retail electric power to customers on Fishers Island. FIEC acquires its electric power at wholesale via underwater cable from Groton Utilities (GU) which receives its electric power from CMEEC. FIEC and CMEEC, in a petition dated June 9, 2010, seek Commission approval pursuant to PSL ~70 for FIEC to lease to CMEEC a parcel for CMEEC's construction of the back-up generator within its service yard on Fishers Island.2 CMEEC states that the project will provide public benefits by enabling it to reduce or mitigate increases in its overall purchased power costs through peak shaving, which in turn will be flowed through to all of CMEEC's customers including GU, and through GU, to FIEC and FIEC's ratepayers on Case 10-E-0282, Joint Petition of Fisher's Island Electric Corporation and Connecticut Municipal Electric Energy Cooperative for Approval under Section 70 of the PSL for Consent to Enter Lease, Request for a Negative Declaration under the State Environmental Quality Review Act and Motion for Expedited Treatment. This requires a notice and comment period as provided for in SAPA §202(1) (a). The SAPA comment period expires August 28, 2010. When the comment period has run, we will address in a separate Order, the request by FIEC and CMEEC pursuant to PSL §70 for FIEC to lease to CMEEC a parcel for CMEEC's construction of the back-up generator on Fishers Island. -2- CASE 10-E-0281 Fishers Island. In addition, it states that the proposed generator will provide a direct benefit to the Fishers Island customers by increasing the reliability of their electric service and mitigating the risk of loss of service due to off island outages. THE CPCN REQUEST No electric generating facilities currently exist on Fishers Island. A backup generator that had existed on the island since the early 1940's was dismantled and removed in January 2009 in anticipation of the completion of this new generator project. Thus, at the present time, Fishers Island's source of electrical power is comprised of (i) an existing underwater electric cable from Groton, Connecticut and (ii) a parallel, but older backup cable which, if called to service when the main cable was out, would be insufficient to support the historic peak summer season electric load. Petitioner relates that recent peak loads experienced on Fishers Island have been 1.976 MW in the summer and 0.832 MW in the off season. Thus, until a new backup generator is installed, Fishers Island is vulnerable to a single-point failure of the underwater cables or of their points of connection on Fishers Island or in Groton. GU acquires its power at wholesale from CMEEC which is a publicly owned joint action agency created in 1978 under Chapter 10la of the Connecticut General Statutes. CMEEC is organized and operated to procure and manage the wholesale power requirements of its constituent municipal electric utilities and is a member of the New England Power Pool. CMEEC owns and operates approximately 107 MW of gas turbine and diesel fired electric generating capacity located in Connecticut, including 11 small generating units similar to the generator proposed to be installed on Fishers Island. These 12 generators comprise -3 CASE 10-E-0281 approximately 22 MW in total capacity. CMEEC intends to construct 20 generators in total for this project to provide peak shaving capacity to enable it to more economically meet the needs of its member systems. CMEEC proposes to locate a 2.5 MW diesel generator on Fishers Island, at CMEEC's expense, to serve as a backup source of electric power for Fishers Island in the event of a failure of the underwater cables, and to increase the adequacy, reliability, and flexibility of its supply system to meet the peak and emergency load of its wholesale customers. The capacity of the proposed generator is adequate to meet the recent and foreseeable peak loads of FIEC's distribution system. CMEEC relates that it has financed its project under a master lease capital financing agreement in the principal amount of $30 million, of which the proposed Fishers Island generator comprises approximately 5% of the total costs. CMEEC issues debt to the public on a periodic basis, subject to public scrutiny. Petitioner reports, that with the exception of the CPCN and other approvals by the Commission, all necessary permits and approvals to construct and install the 2.5 MW diesel generator on the parcel to be leased from FIEC have been obtained. Petitioner further asserts that no opposition to the lease of the property or construction of the generator has been lodged in any venue in which the proposal has been considered, which according to Petitioner include the Town of Southold Planning Board, Zoning Board of Appeals, Suffolk County Department of Health, the New York State Department of Environmental Conservation, and the New England Independent System Operator (ISO-NE). Petitioner states that the generator will be constructed, tested and ready for operation within approximately 40 days of the Commission's approval. -4- CASE 10-E-0281 Petitioner relates that CMEEC proposes to lease from FIEC a currently unused, approximately 3000 square foot parcel of land and access rights as necessary in FIEC's existing utility yard for CMEEC's use in installing and operating the proposed generator. The parcel was previously the site of an electric generator owned by FIEC and as such has ready access for high voltage connection to FIEC's distribution system. CMEEC will incur all costs of the installation and operation of the generator, except for the variable costs of fuel and urea when the generator is operating as a back-up generator for FIEC (Island Mode) during interruption of supply service from GU resulting from a break in the underwater cables or from some other cause on the Connecticut mainland. Except when operating in Island Mode, the generator will be operated remotely by CMEEC from a Network Operations Center in Norwalk, Connecticut and is expected to operate approximately 300 hours per year. When operating in Island Mode, the generator may be operated directly by FIEC. Variable costs incurred during operation in Island Mode will be recovered from customers through FIEC's fuel adjustment clause. Petitioners describe the project as relatively small in scale and as incorporating extensive environmental controls, including state of the art air emissions control systems. The generator will be enclosed in a heavy metal sound insulated structure that reduces noise levels to normal background (65 dba) at 50 feet and is designed to withstand hurricane force winds of 120 mph. CMEEC states that its business is to procure and manage the wholesale power requirements of its member and participant municipal electric facilities located in the State of Connecticut and inter-connected to ISO-NE. CMEEC states that in 2009, it supplied 1,973,155 MWHs of energy and met peak load -5- CASE 10-E-0281 requirements of 367 MWs. It states that its revenues in 2009 were $194,330,000, and therefore, the revenues attributable to the proposed generator should be considered incidental and inconsiderable. Petitioner states that the Department of Environmental Conservation conducted an uncoordinated review pursuant to SEQRA, determined that the proposed project will not have a significant effect on the environment, and issued a negative declaration. DISCUSSION AND CONCLUSION We are authorized to grant a CPCN to an electric corporation pursuant to PSL §68, after due hearing and upon a determination that the construction of electric plant is necessary or convenient for the public service. Our rules establish pertinent evidentiary requirements for a CPCN application (16 NYCRR §21.3). The rules require a description of the plant to be constructed and of the manner in which the cost of such plant is to be financed, and evidence that the proposed plant is in the public interest and is economically feasible, and proof that the applicant is able to finance the project and render adequate service. CMEEC's motion for an expedited proceeding is unopposed. Accordingly, we grant CMEEC's motion for an expedited proceeding. The CPCN request does not require the notice and comment period provided for in SAPA §202(1) (a) . In view of CMEEC's desire to begin construction and operation of the proposed generator, we will address the CPCN request at this time and grant it a CPCN. Environmental Quality Review Under SEQRA, Article 8 of the Environmental Conservation Law, and its implementing regulations, (6 NYCRR -6- CASE 10-E-0281 Part 617 and 16 NYCRR Part 7), all State agencies must determine whether the actions they are requested to approve may have a significant impact on the environment. Besides our approval of the action proposed here, other additional State or local permits or approvals were required and those agencies undertook uncoordinated SEQRA reviews for the issuance of their permits and approvals. We will assume Lead Agency Status under SEQRA and conduct an environmental assessment. SEQP~A (6 NYCRR § 617.6 (a) (3)) requires applicants to submit a completed environmental assessment form (EAF) describing and disclosing the likely impacts of the proposed actions. The Petitioner submitted a short-form EAF Part I. The proposed action is the granting by the Commission of a Certificate of Public Convenience and Necessity pursuant to PSL, §68, for the construction and operation of a 2.5 MW diesel- operated electrical generator by the CMEEC to be installed on the site of a former diesel-operated electrical generator in the existing utility yard of the FIEC on Fishers Island, Town of Southold, Suffolk County, New York. The generator will provide backup emergency electric power generation for Fishers Island and peak shaving generation capacity for CMEEC. The proposed action does not meet the definition of either Type 1 or Type 2 actions that are contained in 6 NYCRR §§ 617.4, 617.5, and 16 NYCRR § 7.2, so it is classified as an "unlisted" action requiring SEQRA review. After review of the EAF and the petition, we conclude, based upon the criteria for determining significance listed in 6 NYCRR ~ 617.7(c), that there will be no physical changes to the property that will result in significant adverse environmental impacts. Our Staff has completed the short-form EAF Part 2. AS lead agency, we determine that the action proposed in the petition will not have a significant impact on the -7- CASE 10-E-0281 environment and we adopt a negative declaration pursuant to SEQRA. Because no adverse environmental impacts were found, no Public Notice Requesting Comments is required or will be issued. A Notice of Determination of Non-Significance for this unlisted action is attached. The completed EAF will be retained in our files. Review by other agencies is discussed in Appendix A. The CPCN CMEEC relates that the proposed generator is one of at least 20 new 2.5 diesel-fired electric generators to be located within the areas served by CMEEC's member and participant electric utilities. The subject petition concerns only the generator to be located on Fishers Island. The remaining units are to be located in Connecticut. Other than Fishers Island, no plant is in New York and no other New York customers are served or affected by the proposed generator. The new diesel fired electric generating units are intended to reduce the monthly and annual peak demands that CMEEC's member and participant utilities place on the New England Electric System administered by ISO-NE. The unit to be located on Fishers Island has the added benefit of being available for use as a rapidly implementable backup for the underwater cables from Groton, which are the only source of electric power to the Island. The lease that has been negotiated between the petitioners provides for an initial term of ten years with the opportunity for CMEEC to renew for an additional five year term. CMEEC will be solely responsible for the expense of construction and operation of the generator except when operated in emergency backup Island Mode, during which time, variable costs would be the responsibility of FIEC, recovered from customers through the purchased power adjustment clause. CASE 10-E-0281 CMEEC asserts that the generator will be equipped with a state of the art air emissions control system and will conform to all applicable air emissions regulations. The heavy metal sound insulated structure surrounding the unit will reduce the noise of the generator and other measures designed to protect the environment are to be implemented. CMEEC states that all required state, county and town approvals have been received, with the exception of that from the Commission. The 2.5 MW generator will serve to provide peak shaving capacity to enable CMEEC to more economically meet the needs of its member systems by enabling CMEEC to reduce or mitigate increases in overall peak demand power purchase costs, thereby benefitting all its customers, including GU and through GU, the customers of FIEC. Significantly, and in addition, the proposed generator will increase the adequacy and reliability of FIEC~s retail service, particularly in the event of an interruption in FIEC's power supply resulting from a break in FIEC's underwater cables or from an interruption from any cause in GU's ability to deliver electric power to FIEC. The unit will be installed at CMEEC expense and operated at CMEEC expense unless it is being used in Island Mode for the benefit of FIEC customers, in which case, it can be operated directly by FIEC and only the variable costs will be incurred by FIEC's customers. The site proposed for lease to CMEEC for location of the generator is one which previously housed a generator and is therefore able to accommodate the proposed unit with little modification. No objection to the proposal is evident. CMEEC is an experienced and financially viable publicly owned energy company. It is experienced in the development and operation of electric projects in the wholesale market. The proposed generator appears to be economically feasible and in the public interest. Based on CMEEC's -9- CASE 10-E-0281 commitments and representations in its petition, we conclude that it will provide safe, reliable and adequate service. A hearing having been held in this proceeding on August 19, 2010, we find as required by PSL §68 that the construction of the proposed generator is necessary and convenient for the public service. The Commission orders: 1. The motion for an expedited proceeding on the uncontested application for PSL §68 certification made by the Connecticut Municipal Electric Energy Cooperative is granted. 2. A certificate or Public Convenience and Necessity is granted to the Connecticut Municipal Electric Energy Cooperative, authorizing the Company to construct and operate the generator, the electric plant described in its petition and in this Order. 3. The Connecticut Municipal Electric Energy Cooperative shall obtain all necessary federal, state and local permits and approvals, and shall implement appropriate mitigation measures defined in such permits or approvals. 4. BRILLING Secretary 10- APPENDIX A REVIEW BY OTHER AGENCIES In addition to the petition for a CPCN it filed with the Commission, the Applicant applied to the NYS Department of Environmental Conservation (DEC) for a New York State Facility Permit under Title V of the Environmental Conservation Law to install and operate a 2.5 megawatt (MW) peaking and emergency backup diesel-engine fired electrical generator to be installed on Fishers Island, Town of Southold, Suffolk County, New York. The permit was issued to Fishers Island Utility Co. on March 15, 2010. DEC undertook an uncoordinated SEQRA of the proposed action (Issuance of a New York State Facility Permit for the diesel- fired electrical generator), determined that the proposed action would not result in any significant adverse environmental impacts, that a Draft Environmental Impact would not be prepared and issued a SEQRA Notice of Determination of Non-Significance, Negative Declaration for the project and the State Facility Permit. DEC's reasons supporting the Determination included: "... (that) the air pollution emissions will not exceed allowable limits and therefore adverse impacts to air quality are not expected; this proposed action is not affect(ing) (sic) water quality, noise levels, traffic, solid waste production, erosion, flooding or drainage patterns in any way; no threatened or endangered species or migratory pathways were identified at this site. Construction that would displace wildlife or destroy (wildlife) habitat is not anticipated; the project is not within a critical environmental area and the air emissions will not impair the characteristics of any nearby critical environmental area; the Project is consistent with local land use plans/zoning and will not significantly change (the) use or intensity of land (uses); CASE 10-E-0251 the site has been previously disturbed. No natural or cultural resources have been indentified on site. The area is presently developed and the neighborhood character (has been) defined. No significant changes to any aesthetic resources are anticipated by this action; (the) Project will not result in a need for additional services or cause expansion of the local area. The changes proposed will not increase energy usage or increase the generation of solid waste; no long term or cumulative impacts were identified or are anticipated; (and) (air) emissions will be subject to enforceable Federal and State limits as well as provision for monitoring and record keeping. Because the emission will meet allowable limits, the emissions are not expected to create a hazard to human health." Petitioner applied to the Suffolk County Health Department for a permit to construct a toxic/hazardous materials storage facility for a new above ground 4200 gallon diesel tank for the generator, a new above ground 150 gallon diesel day tank for the generator and a new above ground 1550 gallon urea tank. The permit was issued on June 22, 2010. The Town of Southold determined that site plan review and additional reviews were necessary. These included a determination whether the proposed action required a separate review by the Suffolk County Planning Commission. The Commission determined the site plan was a matter for local determination by the Town. The Town of Southold Local Waterfront Revitalization Program (LWRP) coordinator determined the proposed project was consistent with the Southold Town LWRP policies. A storm-water runoff analysis was reviewed by the Town Engineer who concluded that the drainage calculations and subsequent drainage design met or exceeded the requirements of the Town Code Chapter 236 Storm Water Management. The Town Zoning Board of Appeals granted a special exemption for the proposed use and the Town Building -2- CASE 10-E-0281 Inspector reviewed the applicant's proposed site plan and certified that the proposed use is a permitted use in the Business Zoning District. DPS Staff conducted its own review and contacted the DEC and Town Planning Department Staff who respectively performed the Facility Permit and the SEQRA reviews. The reviews conducted by these agencies were consistent with DPS Staff's environmental analysis and there are no outstanding issues that need to be addressed. Our Staff concur with the approvals as conditioned by these agencies. On June 15, 2010, the Town Planning Board approved the Applicant's Site Plan. It further conditioned the site plan approval with the following requirements: that a landscape plan will be coordinated with the Planning Board designee and submitted to the Planning Board prior to a Certificate of Occupancy being issued for the approved site plan application; that outdoor lighting will be shielded so the light source will not be visible from adjacent properties and roadways, focusing and directing the light to contain it and glare within the property boundaries; by that storm water run-off from grading, driveways and gravel areas must be contained on site; that the site plan approval will be valid for three years from the date of approval within which time all proposed work must be completed unless the Planning Board grants an extension; that all changes to the approved site plan shall require Planning Board approval; and that before the Certificate of Occupancy is issued, the Planning Board, or its representative, must inspect the site to ensure it is in conformity with the approved site plan and issue a final site inspection approval letter.
