Meeting Hall, 53095 Main Road, Southold, NY. Supervisor Russell opened the meeting at 4:30

SUPERVISOR RUSSELL: Please rise for the Pledge of Allegiance to the Flag. Thank you.
Can everybody please stand again? We actually lost a member of the Town Hall family, Serge
Doyen, he was a member of the Zoning Board of Appeals for almost 40 years, so I am just going
to ask for a moment of silence. He recently passed. Thank you. And I would invite anyone that
would like to comment on any of the agenda items to please feel free to do that at this time.

Peter Terranova, Peconic
PETER TERRANOVA: Good evening, Peter Terranova, Peconic. Just a couple of comments, I
noticed that before the Town Board this evening is the issue of dredging the inlet for 2012. I
notice that the amount that you are looking for for authorization is $50,000 as compared to
$40,000 in prior years, that is a 25 percent increase and I am just wondering what justifies that 25
percent increase?
Supervisor Russell
SUPERVISOR RUSSELL: Well, first of all, that is done each year on county bid. We have to
keep pace with rising costs just like everybody else. There is a minor change in the scoping
scale of the dredging, we have very little options because of the way the permits are written but
we are hoping we would be able to get more material out of the inlet so that we can get the
dredging to last a little bit longer than, you know, the season.

MR. TERRANOVA: I would have thought this year we could have perhaps done with a little
less dredging because the amount of dredging that we did last year which was more than the year
before is one of the factors that I believe has contributed to the erosion of the west bank of the
inlet because when we go so deep we increase the velocity, okay, of the water flowing into the
water flowing into the inlet which contributes to that erosion on the west bank which I know has
been a concern of the Town Board. So you might want to take a look at it plus I understand that
costs are going up but you know, even if we did the same as last year which was more than the
year before, that is still a 25 percent increase.
SUPERVISOR RUSSELL: It is a balancing act though because we are trying to maintain flush
for the inlet itself and yes, at the same time we have issues with the road and we have the DEC
out working with us to develop a long term plan for armoring and protecting that road.
MR. TERRANOVA: Yes. I guess in conjunction with that, I notice there is also another
resolution that has to do with an agreement with the county of Suffolk for the management plan
or report, okay, I think it is one of the last resolutions for $86,000. Now I think this is the
implementation of Mark Terry's management plan? That he had put together.
SUPERVISOR RUSSELL: Yes, that, Suffolk County has actually, Legislator Ed Romaine
secured that money as an appropriation and that is all part of the larger issue of trying to bring

Goldsmiths back to life. It involves DNA testing and all those other things.
MR. TERRANOVA: Okay. So, as I understand it, going back to Ed Romaine's efforts to help
us in this regard, this $85,000, this was a grant that we were able to secure or Ed Romaine was
able to secure?
SUPERVISOR RUSSELL: That is right.
MR. TERRANOVA: So it is not coming out of town money?
SUPERVISOR RUSSELL: No, it is not.
MR. TERRANOVA: Okay. Well, I am in full support of that because I think the thing that the
Town needs to do and you have been working hard to arrive at the point of identifying what the
source of the so-called pollution is, so until such time as we as we get those results and finish
that study, to assume that we need to flush that inlet more okay, is just destroying the west bank.
So, it is just something else to keep in mind.
COUNCILMAN KRUPSKI: Not that, well, the goal isn't just to flush it more, it is to keep it
open also, so (inaudible) if it closes ....
MR. TERRANOVA: I understand that and that was my original point is that I don't believe that
you need to dredge even as much as you did last year because every time we go in there, we
seem to be doing a little bit more each year and it is like when they first started the project to
dredge the Panama Canal, the deeper they went the more the sides collapsed. And that is what is
happening and been happening for the past three or four years ....
COUNCILMAN KRUPSKI: Inaudible.
MR. TERRANOVA: Excuse me?
COUNCILMAN KRUPSKI: I am sorry, Peter, I don't remember that.
MR. TERRANOVA: No, I know. Bill Ruland knows that. But when you dig deeper, you
know, you wind up collapsing the sides...
COUNCILMAN KRUPSKI: Yes.
MR. TERRANOVA: You collapse the sides, then you know, you are putting Mill Road in
danger and I understand all the issues involved here but I am just looking at trying to give you
my opinion.
COUNCILMAN KRUPSKI: Well, thanks. We are constantly evaluating and re-evaluating that.
I was in Mark Terry's office last week and we were looking at some old aerials, trying to figure
out where, it was from back inthe 30's, where the old channel was because ....

MR. TERRANOVA: It was further to the east.
COUNCILMAN KRUPSKI: That is what we thought, a little bit further to the east.
MR. TERRANOVA: Quite a bit. Even if you go back to the 30's, we have some residents in
our community who lived there in the 30's and they are always remarking, why doesn't the town
move it further to the east or allow nature to allow it to go further to the east and I understand
there are restrictions with the state (inaudible) okay? But nonetheless, we can tweak it a little bit
better. Last year we tweaked it by trying to make it straighter and deeper by virtue of the
recommendations for the group, the Group to Save Goldsmiths Inlet brought in. And actually
their recommendations made things worse in terms of further erosion on the west side. So it is
not an easy, there is no easy answers here.

COUNCILMAN RULAND: Mr. Supervisor, I will have to recuse myself from that vote because
there is a conflict of interest between two of the vendors and mysel£
COUNCILMAN TALBOT: I have noted on there that there is one vendor and I have recused
myself on that but I will vote to approve the other ones.

Grant Permission for the 3Rd Annual North Fork Soldier Ride on Saturday, September 1, 2012
RESOLVED the Town Board of the Town of Southold hereby ~rants permission to Wounded
Warrior Project and authorizes a police escort for the 3rd Annual North Fork Soldier Ride
on Saturday, September 1, 2012; the ride will commence at Mitchell Park, Greenport at 8:30 AM
and proceed west on Route 25 to Mattituck Fire Department, north on Wickham Road to Route
48 and east to Moores Lane Park, Greenport; more accomplished riders will continue to Orient
Point and back to Greenport without police escort. Approval is on the condition the applicant
provide written approval from the Village of Greenport and file with the Town Clerk a One
Million Dollar Certificate of Insurance naming the Town of Southold as an additional insured
and contact Chief Flatley upon receipt of the approval of this resolution to coordinate traffic
control. Support is for this year only, as the Southold Town Board continues to evaluate the use
of town roads. All town fees for this event shall be waived.

RESOLVED that the Town Board of the Town of Southold hereby engages the professional
services of the Peconic Land Trust, Incorporated to perform Conservation Planning, Acquisition,
and Professional Services related to the Town's land preservation efforts, and authorizes the
Supervisor to sign the agreement between the Peconic Land Trust, Incorporated and the Town of
Southold, subject to review of the contract language by the Town Attorney. Compensation shall
not exceed fifty-five thousand ($55,000.00) dollars. The contract term shall be from January 1,

COUNCILMAN TALBOT: This has been a year, almost a year to the day, for us to go forward
and get the money and get this project going and get this road opened back up again. I move this

New York, on the 9th day of November, 2011, a Local Law entitled "A Local Law to Amend
the Zonin~ Map of the Town of Southold by Chan~in~ the Zonin~ Designation of a .52-acre
portion of SCTM #1000-140-2-32 from R-40 to RO"; and
WHEREAS, by Local Law No. 30 of 1999, the Town Board of the Town of Southold, in
connection with the County Route 48 Land Use Study, rezoned a portion of a parcel fronting on
Mary's Road, Mattituck, identified as SCTM #1000-140-2-32, from Light Industrial (LI) to R-
40; and
WHEREAS, upon further review of the zoning in the area, the Town Board finds it appropriate
to extend the adjacent Residential Office (RO) zoning to include this .52-acre portion of SCTM
#1000-140-2-32; and

WHEREAS, extending the RO zoning and rezoning the portion of the subject site as RO is
consistent with the zoning of the adjacent area and the comprehensive plan of the Town; and
WHEREAS, the Town Board of the Town of Southold held a public hearing on the aforesaid
Local Law on Tuesday, December 6, 2011 at which time all interested persons were given an
opportunity to be heard; and
WHEREAS, the Town Board has received and reviewed all written comments,
recommendations and reports submitted in this matter; and
WHEREAS, the Town Board declared itself Lead Agency on December 6, 2011 and conducted
a SEQRA review on the proposed zone change, and on December 6, 2011 adopted a negative
declaration pursuant to SEQRA.
NOW, THEREFORE, BE IT
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed
Local Law entitled "A Local Law to Amend the Zonin~ Map of the Town of Southold by
Chan~in~ the Zonin~ Designation of a .52-acre portion of SCTM #1000-140-2-32 from R-40
to RO" which reads as follows:
LOCAL LAW NO. 1 of 2012
Section 1. Purpose.
The Town Board of the Town of Southold has performed the necessary analyses and studies in
connection with the inclusion of this .52-acre portion of SCTM #1000-140-2-32 in the RO zone
and finds that this amendment to the zoning map is consistent with the Town's comprehensive
plan and the zoning in the adjacent area. The purpose of this Local Law is to promote the
planned orderly growth and development of the Town.
Section 2. Code Amendment.
Based upon the Town Board's consideration of the recommendations of the Town Planning
Board, the Suffolk County Planning Commission, the SEQRA report, and the public comments
taken at the public hearing and otherwise, we hereby amend the Official Zoning Map of the
Town of Southold as adopted by Section 280-6 of the Town Code to extend the RO zoning
district to include and incorporate the .52-acre portion of SCTM #1000-140-2-32 with frontage
on Mary's Road as depicted on the attached map. The remaining portion of SCTM #1000-140-
2-32 (the 9-acre portion adjacent to SCTM #1000-140-2-30) shall continue to be zoned LI.
Section 3. Severability.
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
Section 4. Effective Date.

Establish Shellfish Advisory Committee
RESOLVED that the Town Board of the Town of Southold hereby establishes a Shellfish
Advisory Committee, consisting of seven (7) members, whose terms shall be for two (2) years,
commencing March 1, 2012. The mission of the Committee shall be to represent Southold Town
before the NYS Department of Environmental Conservation and regulatory agency(s) having
responsibility and statutory authority in matters relating to the sanitary certification and water
quality testing of Town-owned shellfish harvest lands. The purpose of the Committee shall be to
facilitate the timely certification/recertification of Town shellfish lands with the goal of
improved harvest status of Town waters. The Committee shall be advisory to the Town Board
and Town Trustees but may act in an advisory capacity to other Southold Town Boards and
Committees upon written request; and be it further

SUPERVISOR RUSSELL: My personal thanks to Trustee Jay Bredemeyer, who has put a lot of
work and effort into pretty much bringing a committee back that we had back in the early 90's
and giving it a good mission statement.
COUNCILMAN KRUPSKI: Which actually Trustee Bredemeyer was part of, very instrumental
in getting that committee active and it was very productive at that time.

SUPERVISOR RUSSELL: With that concluding the business of the agenda, would anybody
like to comment before the Town Board on any issue?
Peter Terranova
PETER TERRANOVA: Peter Terranova, Peconic. I believe this is the last official Town Board
meeting of Councilman Orlando.
COUNCILMAN ORLANDO: That would be correct.
MR. TERRANOVA: I would just like to stand up here and recognize and honor the service of
Vincent Orlando as a Councilman for the Town of Southold. Four years ago, Vincent came
forward to serve his and this community, he brought wise council, a caring attitude and
conservative values that has served our town very well. Typical of public servants of years
passed, Vincent has decided to step down or step aside and let another take his place and
contribute their talents to town government. Vincent, the town will miss you. I know you will be
successful in whatever endeavor you decide to pursue. My only bit of advice is stay away from
Garden City. Thank you, Vincent.

SUPERVISOR RUSSELL: That is actually a nice segue into our presentation which seems
wholly inadequate for the amount of hours that Vinnie has committed to this job over the past
four years. I came into this running with Vincent and Bill and it has been an absolute honor to
serve with Vincent, he is a person of astounding energy, ability and integrity. I have a
proclamation I will quickly present to him, I will quickly read and also we have another
presentation I would like to make on behalf of the entire Town Board. 'Whereas Mr. Vincent
Orlando, a most dedicated official of the Town of Southold is leaving public service on
December 31, 2011 whereas Councilman Orlando has given generously of his time and talent
and has provided faithful service to the residents of Southold Town, as a member of the Town
Board since January 1, 2008, whereas Councilman Orlando's record of unwavering service and
diligence to duty to the Town of Southold deserves the sincere gratitude of those with whom and
for whom he has served, now therefore be it resolved that the Town Board of the Town of
Southold hereby expresses sincere appreciation to Councilman Vincent Orlando for his
unselfless and untiring efforts on behalf of Southold Town and extends their best wishes for the
years ahead, be it further resolved that a copy of this resolution be presented to Councilman
Vincent Orlando and entered into the permanent records of this Town Board.' Dated December
20, 2011, signed by myself and the entire Town Board. We also have another presentation for
you. We actually, it was very difficult to figure out what to get Vincent. So what we decided
was to come up with as unique a gift as possible. This is actually a painting of Goldsmiths Inlet,
Goldsmiths pond painted by our own Mark Terry and we are going to present that to you.

SUPERVISOR RUSSELL: Inaudible. And I mean this with absolute sincerity, Vinnie, I have to
tell you you are going to be missed. I begged you, I pleaded with you to stay when we were,
during the nominating convention. I completely understand but we are going to miss you, every
meeting.

COUNCILMAN ORLANDO: Well, I am going to miss everyone here and it has been my honor
and privilege that the great people of town, Southold township, gave me an opportunity to be
their councilman/public servant. And I enjoyed the entire moment of these past four years, they
flew right by and it is true what they say, time flies when you are having fun. I had an amazing
trip here, I wish Jill all the luck in the world following my footsteps and I have to personally
thank everyone here, Councilman Ruland, thank you so much. Councilman Krupski.
Councilman Talbot, Attorney Finnegan, Betty and of course, Supervisor Russell. Thank you. I
have spent a lot of time with these people and they have become my town family and I have
worked a lot with the Highway Department and DPW and a lot of people in town and with the
hours were put in, after four years, they become your family, you know a lot about them and
their personal lives and I will miss that and I have to thank my wife and my family for putting up
with all the hours away and dragging you to all those events. It was a special time, I will miss it
but I have to say this is not goodbye, just I will see you later. Thank you for the kind words.

COUNCILMAN KRUPSKI: I would just like to say, I have served with an awful lot of people
in town government and it has been an honor and a privilege to serve with you. You brought a
lot, an awful lot to the Board, you worked hard for the town every day. I know I appreciate it
and I know the whole town does, too.
COUNCILMAN ORLANDO: There is one thing I would like to add, even though people on
this dais right here, some come from different parties, the Town Board here that I have worked
with for the last four years, I had one thing in mind, what is best for the town, whether it is a
project or finances, it is always what is best for the town and I think that is a pretty special thing
we have here. That we did. Thank you.
