This application must be filled in by typewriter or ink and submitted to the Building Department with the following:

SE RA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the Sfate's List of Actions,
without further steps under SEQRA.
PROPERTY FACTS/DESCRIPTION: The applicant's property is improved with a main dwelling with three
apartments and a two-family dwelling, evidenced by the Building Inspector's July 13, 2006 Preexisting
Certificate of Occupancy No. Z-31715. Formerly. the property contained a two-story frame hotel and 1-1/2
story frame annex with garage and separate shower structures, as shown on the October 20, 1965 survey
prepared by R. Van Tuyl, Land Surveyor.
BASI~: Based on the Building Inspector's August 22, 2006 Notice of Disapproval citing
Section 100-241 (280-121A), a variance is requested to make alterations lo convert the existing main building
with three apartmer~ts into a single-family dwelling with two apartments.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on October 26, 2006, at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of
the property, and other evidence, the Zoning Board finds the following facts to be true and relevant:
RELIEF ~; The applicant wishes to make infarior and roof alterations to an existing dwelling with
three apartments, converting the main building to a single.-family dwelling with two rental apartments, as more
specifically detailed on a September 21, 2006 site diagram and related drawings prepared by James A,
Richter, R.A.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a
delriment to nearby properties. The construction of a second-floor addition over a portion of the existing
building footprint is a need to replace a portion that is in disrepair. All proposed alterations will not increase
the size of the structure and the applicant is requesting a reduction in the number of units of this preexisting
building.

2, The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to
pursue, ether than an area variance, The building was used as a hotel many years ago and has since
remained in its existing Jocafion (or footprint).
3. The vadance granted herein is not substantial.
4. The difficulty has not been self-created.
5. No evidence has been submitted to suggest that a variance in this residential community will have an
adverse impact on the physical or environmenbal conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy
the benefit of the preexisting dwelling structure, while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Chairwoman Oliva, and duly
carried, to
GRANT the variance as applied for, as shown on the September 21,2006 Diagrams A1 through A4,
and Diagrams S1, EX1 through EX4, prepared by James A. Richter, R.A.

remained in its existing ]ocation (or footprint).
