the following action was taken at a Regular Meeting of the
board held on Thursday, April 19, 1984 concerning the above
application:
RESOLVED, that the conditional action rendered by this
board at its April 5, 1984 Special Meeting concerning the
application for the NORTH FORK BAPTIST CHURCH in Appeal No.
3218, BE AND HEREBY IS RESCINDED, and be it further
RESOLVED, that Appeal No. 3218, application for the NORTH
FORK BAPTIST CHURCH be and hereby is WITHDRAWN WITH PREJUDICE.
This resolution was unanimously adopted.
Since you have stated that it is your intention to proceed
with the original plan approved in Appeal No. 3197 on January 25,
1984, please contact the Building Inspector for the appropriate

Re: North Fork Baptist Church Variance
Gentlemen:
I object to the North Fork Baptist Church placing a modular
home on the lot adjacent to my property located on Westphalia Rd.
in Mattituck. According to the property map, the hc~ewill be
located just 10' from our cc~mon property line. My home itself
is located very close to that property line as a result of the
creek being filled in several years ago. It is my understanding
that a building must not be closer than 20' from a side property
line according to the zoning codes of Southold Town (Article III,
Section 100-30 (B)).
I fail to understand why this home sould be sandwiched in
between two houses on Westphalia Road when the church owns an
approximately 3½ acre parcel of property. This would provide
opportunity for this parcel to be sectioned off and sold at a
later date.
When I received the certified letter in the mail, there was
no map enclosed with it. I assumed the home wouldbe in an area
closer to the church. A neighbor (who did receive a map) contacted
me and informed me of the exact location which is the reason I have
not written my disapproval at an earlier date.
I hope the board members will take my letter into consideration
when making their decision on this variance request.

Dear Sirs:
I want to enter a strong protest againsth the Planning Board
granting a permit to the Baptist Church on Route 48 in Matti-
tuck to place a mobile home on the lot on Westphalia road
between the Rosenfeld house and the McCaffery house.
For one thing the lot is too small, and secondlyt if such a
house is placed it will change the appearance of the area.
You should definitely look into this because of the cesspool
problems~ especially since that is all filled in ground.
If you could let us know when this matter is coming before the
Planning Board we will arrange to have several residents of
this area present to protest the granting of the permit.

Dear Sirs:
I write this letter with a great sense of deja vu,
not six months ago we hashed out the advisability of using
the small strip of land between my house and McCaffreys on
the north.
Nothing has changed:
1. the land is not sufficient for any type
of home
2. Zoning code now calls for two ac~es.
3. Cess pools and wells would be difficut on
so little land.
4. The privacy of both McCaffreys and ~h~
Rosenfelds would be violated to the point
we would have to erect fences, a true
hardship.
5. A trailer home would decrease the value of
all property bordering it.
6. It would constitute a deteriorating influence
by downgrading the neighborhood.
I hope the zoning board of appeals will not allow this
this travesty to take place.

A Variance to the Zoning Ordinance
is requested for the reason that we would like to locate the house the house so that
it would face Westphalia Road & thus be some distance from the current parkin_~ are8
and the basketball court.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because 1. We would be unable to locate the house in the area chosen
unless it was placed with the side of the house facing the road rather than the front.
2. ~r youth pastor and his wife are expecting a child in the near future, we feel that
the olcatimn requested would be less dangerous and quieter.
3. In the future , we hope that our church will grow. In the event that a larger
facility is required, the construction could take place in our current parking lo~
and play area.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because the other properties were not
forced to conform with the existing town ordinance as construction took place
befor the current, laws were in olace.
3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the setbacks on the majoritv of the dw~.ll.in~s do not
conform with the zoning ordinance.

an application to the N.Y.S. Department of Environmental Conservation, Environmental
Analysis Unit, Building 40, S.U.N.Y., Stony Brook, NY 11794, (tel. 516-751-7900), if
you have checked Box #1 and/or Box #6 below. Please either call their office or
personally visit them at their Stony Brook office for instructions and application
forms. Once you have received written notification of approva please provide our
office with a copy (with the conditions) as early as possible in order that we may
continue processing your Z.B.A. application.
