Request for Variances from Article XXII Code Section 280-116 and Article III Section 280-14 and the
Building Inspector's February 25, 2011 updated June 9, 2011 Notice of Disapproval based on an
application for building permit for reconstruction of an existing dwelling with third story addition at: 1 )
less than the code required setback of 75 feet from a bulkhead, 2) more than the cede required number
of stories of 21/2, located at: 1165 Kimberly Lane ( adj. to Southold Bay) Southold, NY. SCTM#1000-
70-13-20.7
A site visit was conducted on August 1,2011. The proposed action has been reviewed to Chapter 268,
Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront
Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records available to me, it
is my recommendation that the proposed action is INCONSISTENT with the Policy Standard and
therefore is INCONSISTENT with the following LWRP policy:
Policy 5: Protect and Improve Water Quality in the Town of Southold.
The applicant referenced a relocated sanitary system and storm water controls (drywells etc...),
however, they are not shown on the submitted materials and therefore an assessment cannot be made.
It is recommended that the Board require that the applicant show the locations of a new sanitary
system and storm water controls in compliance with Town of Southold Town code.
In the event the action is approved it is recommended that a 25 wide, landscaped buffer (excluding the
existing beach access area) be required landward of the bulkhead to further Policy 6; Protect and
Restore the Quality and Function of the Town of Southold Ecosystem (D) below. An example definition
of a landscape buffer follows the policies for your use:
Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order
to ensure protection of the wetland°s character, quality, values, and functions. The adequacy of
the buffer depends on the following factors:
Potential for adverse effects associated with the use. Uses such as those
involving hazardous materials, on-site sewage disposal, or mineral extraction
have high potential for adverse effects and may require substantial buffer.
The nature and importance of the wetland and its benefits. Substantial buffers
may be necessary to avoid adverse effects from adjacent or nearby uses based
on the nature of the land use and the characteristics of the affected wetland.
Direction and f~ow of surface water between a use and adjacent or nearby
wetland. Buffer widths may be reduced in areas where drainage patterns
normally do not lead directly to the wetland and where adverse affects on the
wetland, other than those due to runoff, are not likely.
Buffer width necessary to achieve a high particulate filtration efficiency of surface
runoff as determined by vegetative cover type, soil characteristics, and slope of
land.
Other management measures or design alternatives to protect wetlands from
adverse effects where site constraints do not allow sufficient buffer width.
LANDSCAPED BUFFER -- A land area of a certain length and width which is planted with indigenous,
drought-tolerant vegetation similar to that found within the immediate proximity of the parcel. Vegetation
shall be installed in sufficient densities to achieve 95% ground cover within two years of installation.
Survival of planted vegetation shall be 90% for a period of three years. Maintenance activities within the
buffer are limited to removing vegetation which is hazardous to life and property, trimming tree limbs up
to a height of 15 feet to maintain viewsheds, replanting of vegetation and establishing a four-foot-wide
access path constructed of pervious material for access to the water body. [Added 12-15-2009 by L.L.

There are three large trees on the north property line; it is recommended that the proposed 12' asphalt
driveway be designed to minimize impact to the trees and/or root system.
Pursuant to Chapter 268, the Southoid Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the proposed
action.

BUTTAFUOCO RESIDENCE -Pro[ect Description
The project proposes additions and alterations to an existing two story singlc family
residence. The project will expand the footprint of the house with an addition at the north-
east comer of the house (approximately 19.4' x 20.8') to square off the structure and form
a full rectangular shapg. There will be a one story addition at the north-west comer of the
dwelling to expand the existing attached garage, approximately 5.0' wide x 31.82' long.
Many of the interior partitions of the first floor will be modified or removed to convert
certain rooms into other spaces and different uses. We proposed the construction of a one
story roofed over porch at the south-west comer of the house near the entry area
(approximately 10.0' deep x 31.0' wide) and a two level open porch across the easterly
side of the house, 8.0' deep by 65.42'1ong, with a slightly widened deck area at the south-
east comer that will project a total of 12.0' from the main dwelling. The ground floor
level of the open porches will be constructed to allow any storm water run-off to penetrate
to the area below and percolate into the ground. This proposed construction will require
the removal of an existing wood deck (approximately 20.0' deep x 18.0' wide) located at
the easterly side of the house that currently projects out further and closer to the bulkhead
and water than the proposed additions and new porches. The project will also remove and
replace the current partial second floor with a new full second story and a new attic area
that will be constructed large enough to be deemed a third story. The current structure has
a partial basement area below, but the proposed additions will be constructed with new
crawl space areas.
The exterior aesthetics of the altered house will include new siding of a cedar shingle look
with white trim & comer boards, decorative columns at tl~e open porches, an Architectural
and dimensional style roofing material and wood (or synthetic composition style) decking
at the open porch areas. We propose new windows and doors a'llowing more viewing
opportunities to the east towards Southold Bay. The house will not be expanded towards
any of the neighbors and will therefore not pose a problem to the privacy of the adjoining
property owners.
The residence currently has a sanitary septic system located east of the structure. The
project proposes eliminating this current system and creating a new sanitary septic system
to the west of the house. This new system will be more landward and further away from
Southold Bay.
The project proposes the re-directing of the current driveway, but the majority of the
current landscaping and vegetation will remain "as is". Every effort will be taken to
maintain the conditions of the existing site and water-run-off protection will be provided
as required to ensure site containment. New storm water collection drywells will be
installed and the roof gutters & leaders will be tied directly into those drywells.

proposed actions that am subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
