The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is INCONSISTENT with the Policy Standards and
therefore is INCONSISTENT with the LWRP provided the following:
The applicant mentions on the LWPR Coastal Assessment Form that parcel will be filled
in the northeastern section of the property. The details of the proposal are not shown.
It is recommended that the applicant provide the elevations of fill to the Board to better
assess site drainage.
.Location and composition of erosion controls to minimize damage to wetland
vegetation during demolition and construction are not shown on the survey. It is
recommended that the Board require that the locations of construction/erosion controls
be shown.
It is recommended that the Board require complete removal of the current structure and
have applicant specify the restoration of the area (buffer).
If the action is approved to further Policy 5: Protect and Improve Water Quality in the Town of
Southold and Policy 6; Protect and Restore the Quality and Function of the Town of Southold
Ecosystem it is recommended that a 25' landscaped buffer be required landward of the
wetlands (where possible), Fertilization and pesticide use within the buffer should be
prohibited.
LANDSCAPED BUFFER -- A land area of a certain length and width which is planted with
indigenous, drought-tolerant vegetation similar to that found within the immediate proximity of
the pamel. Vegetation shall be installed in sufficient densities to achieve 95% ground cover
within two years of installation. Survival of planted vegetation shall be 90% for a period of three
years. Maintenance activities within the buffer are limited to removing vegetation which is
hazardous to life and property, trimming tree limbs up to a height of 15 feet to maintain
viewsheds, replanting of vegetation and establishing a four-foot-wide access path constructed
of pervious material for access to the water body. [Added 12-15-2009 by L.L. No. 15-2009]
It is further recommended that the Board preserve the large oak tree east of the current
structure to the greatest extent practicable. The proposed terrace may need to be
redesigned to include a tree well to accomplish this.
Figure 1. Subject parcel showing location of large oak tree.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.
