Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Jill Doherty, President Town of Southold Board of Trustees From: MarkTerry, Principal Planner LWRP Coordinator Date: August 19, 2011 Re' Proposed Wetland Permit for LISA GRATTAN SCTM#1000-116-6-9 Downs Creek is a New York State Significant Fish and Wildlife Habitat Area and a New York State Department of Environmental Conservation Critical Environmental Area. A site inspection was conducted on August 19, 2011. Suffolk Environmental Consulting, Inc. on behalf of LISA GRATTAN requests a Wetland Permit to remove the existing 2,465 sf. single-family dwelling, pomhes, brick patio and sanitary system; construct new 3,250 sr. single-family dwelling, rear terrace containing a swimming pool and spa, screened rec-room/cabana, screened terrace, and upgraded sanitary system surrounded by a 120' retaining wall. Located: 11860 New Suffolk Ave., Cutchogue. SCTM#116-6-9 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP provided the following: The applicant mentions on the LWPR Coastal Assessment Form that parcel will be filled in the northeastern section of the property. The details of the proposal are not shown. It is recommended that the applicant provide the elevations of fill to the Board to better assess site drainage. .Location and composition of erosion controls to minimize damage to wetland vegetation during demolition and construction are not shown on the survey. It is recommended that the Board require that the locations of construction/erosion controls be shown. It is recommended that the Board require complete removal of the current structure and have applicant specify the restoration of the area (buffer). If the action is approved to further Policy 5: Protect and Improve Water Quality in the Town of Southold and Policy 6; Protect and Restore the Quality and Function of the Town of Southold Ecosystem it is recommended that a 25' landscaped buffer be required landward of the wetlands (where possible), Fertilization and pesticide use within the buffer should be prohibited. LANDSCAPED BUFFER -- A land area of a certain length and width which is planted with indigenous, drought-tolerant vegetation similar to that found within the immediate proximity of the pamel. Vegetation shall be installed in sufficient densities to achieve 95% ground cover within two years of installation. Survival of planted vegetation shall be 90% for a period of three years. Maintenance activities within the buffer are limited to removing vegetation which is hazardous to life and property, trimming tree limbs up to a height of 15 feet to maintain viewsheds, replanting of vegetation and establishing a four-foot-wide access path constructed of pervious material for access to the water body. [Added 12-15-2009 by L.L. No. 15-2009] It is further recommended that the Board preserve the large oak tree east of the current structure to the greatest extent practicable. The proposed terrace may need to be redesigned to include a tree well to accomplish this. Figure 1. Subject parcel showing location of large oak tree. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes", then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. A copy of the LWRP is available in the following places: online at the Town of Southold's website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local libraries and the Town Clerk's office. The proposal, as desi.qned, will not result in any adverse effects to the surroundin.q environment in that the proiect will be situated further landward from the wetlands boundary than what currently exists thereon.
