En-Consultants on behalf of GERALD & ROSEMARY REIDY requests a Wetland Permit to
construct approx. 79 If. of vinyl bulkhead in place of existing timber bulkhead; relocate existing
4'X 5' deck and 3'X 5' steps to beach; remove and replace 2' boardwalk over 19' section of
bulkhead; backfill with up to 10 cy. clean sand fill to be trucked in from an upland soume; and
remove and replace existing masonry patio (as necessary) except for 5' area adjacent to
bulkhead to be replaced with 5' non-turf buffer. Located: 167 Island View Lane, Greenport.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the LWRP review provided
the following best management practices are required:
The applicant proposed a non-turf buffer adjacent to the bulkhead. The composition of
the buffer is unspecified.
If the action is approved, to further Poficy 5: Protect and Improve Water Quality in the Town of
Southold and Poficy 6; Protect and Restore the Quality and Function of the Town of Southold
Ecosystem it is recommended that the Board require a silt boom during construction.
§ 275-11. Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of
the Trustees:
(2) Erosion control. Installation of an erosion control structure is necessary during any
building, grading, landscaping or site work activity within Trustee jurisdiction. This structure
may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt
booms. The placement of the erosion control structure(s) shall be determined by the Trustees
or their designee. All intertidal construction and excavation requires the installation of a
silt boom that will retain all suspended sediments within the immediate project area.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail., listing both supporting and non-
suDDortim, facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

The existing, developed site has been improved with and supported and protected from flooding and erosion by a bulkhead since prior to
1977, and the project seeks to maintain this existing condition through the ordinary and routine in-place replacement of the bulkhead.
There is no viable non-structural alternative means of maintaining and protecting the owner's dwelling and upland portion of the parcel
in its current location. Therefore, the project is consistent with Policy 4 to the extent this policy can be applied to the in-place
replacement of an existing bulkhead.
