Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Jill Doherty, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: August 17, 2011 Re: Proposed Wetland Permit for JEANNE MARKEL & JOHN CHRISTIAN WEDGE SCTM# 1000-27-4-3.1 Eh-Consultants on behalf of JEANNE MARKEL & JOHN CHRISTIAN WEDGE requests a Wetland Permit to remove existing two-story, one-family dwelling, garage and deck, and construct new two-story one-family dwelling with attached decks; construct retaining wall and place approx. 40 cy. fill within 100' of wetlands to achieve proposed grades more than 50' from wetlands; clear approx. 783 sf. of existing wooded area within 100' of wetlands to establish yard and pervious dirt pathway more than 50' from wetlands; revegetate and maintain as landscape buffer approx. 1,123 sf. of existing cleared area within CEHA; replace ddnking water well; and establish stormwater retention basin and other components of drainage system. Located: 100 Harbor Rd., Orient. SCTM#27-4-3.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. It is recommended that the Board require species composition and maintenance parameters within the proposed landscaped buffer. Also note that the sanitary systems leaching pools are proposed with a 2' separation distance from groundwater. Recent studies have indicated that these types of sanitary systems are contributing to adverse surface water quality impacts via subsurface pollutant loading. Although the sanitary system is located out of Board's jurisdiction, the system has the ability to affect water quality within the Boards jurisdiction. I recommend that the Board address this issue in the future. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its wdtten determination regarding the consistency of the proposed action. Yes [--] No [~ Not Applicable The existing site is characterized by a two-story, one-family dwelling with attached garage and deck located approximately 51 feet from unvegetated tidal wetlands associated with Orient Harbor and 101 feet from freshwater wetlands located to the west of the property. The proposal seeks to remove these existing improvements and locate a new 2-story dwelling and deck no closer than 78 feet from tidal wetlands and 104 feet from the adjacent freshwater wetlands, an increase in the minimum wetlands setback of 27 feet, i.e., a greater than 50 percent improvement on the existing setback. Structural ground area coverage within 100 feet of wetlands will in turn be reduced by more than 50 percent or by 1,085 square feet to 942 square feet from the existing 2,027 square feet. The project will also replace the existing nonconforming sanitary system with an upgraded system located mom than 150 feet from wetlands and install a drainage system to capture and recharge roof and stormwater runoff. Moreover, approximately 1,128 square feet of existing cleared area located seaward of the Coastal Erosion Hazard Area boundary will be revegetated with native vegetation and maintained as a landscape buffer so that no developed portions of the property will remain within the Coastal Erosion Hazard Area. Although the newly proposed structures do not meet a 100-foot setback from the tidal wetlands boundary, existing wetlands setbacks are increased by more than 50 percent and structural coverage within wetlands jurisdiction is reduced by more than 50 percent. This project design and the incorporated mitigation measures provide the following environmental benefits with respect to the protection and restoration of the adjacent wetlands and Orient Harbor ecosystem: a) decreased structural footprint adjacent to wetlands and increased separation between structures and wetlands; b) potential improvement in groundwater quality through improved treatment of on-site septic and increased separation distance between septic and wetlands; c) reduction in potential volume of roof and stormwater runoff reaching Orient Harbor; d) improvement in quality of runoff that does roach Orient Harbor through the replacement of existing, potentially chemically dependent lawn/landscape areas with a native vegetation landscape buffer and through the buffer's ability to act as a sink for such chemicals before they reach surface waters. Therefore, the project will be consistent with the Policy 6 goal of protecting and restoring the quality and function of the Town of Southold's ecosystems.
