En-Consultants on behalf of THEODORE & MARIA PETIKAS requests a Wetland Permit and
Coastal Erosion Permit to construct approx. 50 If. of retaining wall and (2) +/-12' returns; install
+/-1 ton stone toe armor along retaining wall; and backfill with approx. 50 cy. of clean sand to
be trucked in from an upland source. Located: 52755 North Rd., Southold. SCTM#135-1-27
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the denoted following Policy
Standards and therefore is CONSISTENT with the LWRP:
This recommendation was made with consideration of the physical location of the residential
structure and hi.qh rate of erosion from storm surqe in the area.
Policy 4.1: Minimize losses of human life and structures from flooding and erosion hazards.

Pursuant to Chapter 275-1 l(B)(l)(b and e), the proposed retaining wall is proposed along a stretch of Long Island Sound that has been
severely impacted by extreme and excessive erosion during the past several years, culminating with an avulsive loss of beach at the
subject and adjacent properties during the Christmas 2010 Blizzard. In response to this erosion, the Pologeorgis property to the
immediate west of this parcel gained approval to construct a retaining wall and stone armor; the Town of Southold public beach parking
lot immediately to the east underwent extensive repairs and restoration; and the next privately owned parcel to the east of the Town
Beach (Tumbull) was recently granted approval to construct a bulkhead/retaining wall with stone toe armor at the toe of the bluff. The
bluff to the east of Tumbull is also armored with a retaining wall, and the property to the west of Pologeorgis is protected by a concrete
seawall. Therefore, the subject parcel, whose dwelling is located farther seaward than any of these other dwellings and structures, is the
only parcel remaining in this cell without some form of erosion protection. Given the absence of any natural protective feature that can
protect the dwelling and the recently demonstrated vulnerability of this stretch of shoreline to severe storm damage, providing a hard
stabilization remedy is the only practicable design consideration that can effectively provide protection for the applicants' dwelling and
immediately adjacent beachfront. Pursuant to Chapter 275-1 l(B)(l)(c), the proposed wall would be armored with toe stone to dissipate
reflective wave energy, and pursuant to Chapter 275-11 (BX 1)(d), the area between the dwelling structures and proposed wall would be
maintained as a sandy nonturf buffer. Given the use of toe stone and the presence of surrounding hard structures, the project will not
increase erosion at adjacent properties. The project would have no impacts on the adjacent unvegetated tidal wetlands or waters of Long
Island Sound. The project is therefore consistent with Policy 4.
