Box 1179 Southold, N-Y 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Jill Doherty, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: September 19, 2011 Re: Proposed Wetland Permit and Coastal Erosion Hazard Area Permit for NICK CUTRONE SCTM# 1000-99-3-07 Peter Gerace on behalf of NICK CUTRONE requests a Wetland Permit and Coastal Erosion Permit to construct a 15'X 18'3" second-story addition to the existing one-family dwelling; add wood deck at first floor 29'7"X 8'8"; and maintain existing 9'8"X 24'9" wood deck at rear of residence. Located: 786 Bailie Beach Rd., Mattituck. SCTM#99-3-7 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the "as built" 9'.8" x 24.9" deck is INCONSISTENT with the below denoted Policy Standards and therefore is INCONSISTENT with the LWRP. Poficy 4. 1 "Minimize losses of human life and structures from flooding and erosion hazards. ' The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended: specifically A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. The "as built" 9'.8" x 24.9" deck is located within the Coastal Erosion Hazard Area is a requlated activity and not permissible pursuant to Chapter 111 i Coastal Erosion Hazard Areas. Figure 1. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. b. water-dependent uses which cannot avoid exposure to hazards. c. sites in areas with extensive public investment, public infrastructure, or major public facilities. d. sites where relocation of an existing structure is not practical The "as built" 9'.8" x 24.9" deck does not functionally require a location on the coast, is not water dependent and can be re-located to a location outside of the Coastal Erosion Hazard Area. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wet/ands. A. Comply with statutory and regulatory requirements of the Southeld Town Board of Trustees laws and regulations for all Andros Patent and other /ands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions The 9'.8" x 24.9" deck was constructed without a permit pursuant to Chapter 275 Wetlands and Shorelines and Chapter 111 Coastal Erosion Hazard Areas of the Southold Town Code. The proposed addition at less than 100 foot setback from top of bluff is CONSISTENT with the LWRP policy standards and therefore CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes", then t affect the achievement of the LWRP policy standards and law. Thus, the action should be analyzed in more detail and, if modified prior to making a determination that it is consistent to the maximum practicable with the LWRP policy standards and conditions. If an action cannot be as consistent with the LWRP policy standards and conditions, it shall not be undertaken.
