Located: 680 Lake Dr., Southold. SCTM#80-3- 21.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Southold Bay, Town of Southold, Suffolk County Request for Necessary Data and Information The Department of State received your Federal Consistency Assessment Form and consistency certification and supporting information regarding the above matter on February 14, 2011. Pursuant to 15 CFR Part 930.58, the following necessary data and information is required to enable the Department of State to adequately assess and undertake its review of the coastal zone effects of this proposed activity: Please provide an analysis of alteruatives to the proposed project. This analysis should at least include the no action alternative, as well as alternatives that consider removing the proposed 16', 21', and 20' sections of the proposed bulkhead, reducing the size of the proposed structure which does not appear to be necessary to maintain the existing channel. Please submit documentation of the ownership, or permission of the owner, of the underwater lands in which the existing and proposed structures will occupy. Documentation of prior authorization for the construction of the existing structures would also be helpful. Please provide the necessary information requested above as soon as possible, lfthis necessary information and data is not provided within thirty days of the date of this letter, the Department of State may close the file regarding this proposed activity. If the Department closes the file and does not concur with the consistency certification provided for this proposed activity, the consistency provisions of the federal Coastal Zone Management Act prohibit federal agency authorization of the activity.
