Studio a/b Architects on behalf of JANE G. WEILAND requests a Wetland Permit to construct an on-
ground boardwalk attached to the existing wood walkway, 32 sf. storage shed and bench, both
attached to the boardwalk platform, total coverage 326 sf. Located: 6485 Nassau Point Rd., Cutchogue.

The proposed action (construct wood steps from upland grade over existing retaining wall and
over existing bulkhead for private access to beach) has been reviewed to Chapter 268, Waterfront
Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency
Assessment Form submitted to this department, as well as the records available to me, it is my
recommendation that the replacements of bulkheads is CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP
'Note: The construction of a proposed 326 square foot deck is not a permissible action pursuant
to 275-11 Construction and operation standards, A (6) and is INCONSISTENT with LWRP Policy 6.3
(below) and therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other /ands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
275-11 Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of the
Trustees:

Decks and platforms. No decks or platforms shall be permitted on or near
bluffs. Platforms associated with stairs may not be larger than 32 square
feet. [Amended I0-11-2005 by L.L. No. t7-2005]
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Wateffxont Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfiont Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon thc coastal area (which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thns~ each answer must be explained in detaii~ listing both supporting and non-
supportin~ facts. If an action cannot be certified as consistent with th~ LWRP policy standards and
conditions, it shall not be undertaken.

Prooosed oroie~t enhacl~es visual aualitv and orotect scenic resources as following: The oroiect uses simple,
minimal, and conventional form. It is carefully sized and located in the narrow strip of existinq fiat terrain under
the cliff behind the bulkhead. Use of natural material with naturally aged finish will match existing structures in
the area, and will add interest to and balance with the existing shared dock. The decking has been configured
not to disturb the naturally vegetated cliff to maintain existing earth form and plants. The deck is also designed
to accommodate additional native costal plants on the surrounding bear sandy soil.
