Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF $OUTHOLD MEMORANDUM To: Jill Doherty, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: May 17, 2011 Re: Proposed Wetland Permit & Coastal Erosion Permit for JAMES & DENISE MARTIN SCTM# 1000-123-4-11 Samuels & Steelman Architects on behalf of JAMES & DENISE MARTIN requests a Wetland Permit to demolish the existing single-family dwelling and abandon the sanitary system; construct new dwelling on pilings and sanitary system with fill; new permeable driveway; and attached two-car garage. Located: 2740 Deep Hole Dr., Mattituck. SCTM#123-4-11 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below noted policies of the program and therefore is INCONSISTENT with LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practica/. a. No development is permitted in natural protective feature areas, except as specifically allowed under the relevant portions of 6 NYCRF~ 505.8. The proposed new location of the residence is a Beach and the construction of a residential structure on a Beach is not permissible. Chapter 275 defines a "Beach "as: BEA CH - The zone of unconsolidated earth that extends landward from the mean Iow water line to the seaward toe of a dune or bluff, or whichever is most seaward. Where no dune or bluff exists landward of a beach, the landward limit of a beach is 100 feet landward from the place where there is ~ marked chanqe in materfal or physiographic form from the line of permanent vegetation, whichever is most seaward. Shore/ands subject to seasonal or frequent over wash or inundation are considered to be beaches. It is recommended that the structure be located further landward. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: structures which functionally require a location on the coast or in coastal waters. B. water-dependent uses which cannot avoid exposure to hazards. c. sites where relocation of an existing structure is not practical. The proposed use is a sin.qle family residence, not water dependent and does not meet criteria a throu.qh c above. The proposed location is located in Flood Zone X - Areas of 0.2% annual chance flood; areas of 1% annual chance flood with averaqe depths of less than 1 foot or with a drainage area less than 1 square mile. The area within Flood Zone X is surrounded by Zone AE {el 6). To minimize property dama.qe and/or health safety and welfare of the occupants of the new residential structure it is recommended that the new residential structure be re-located landward adjacent to Deep Hole Drive and in line (not proiect further seaward) with existin,q residential structures on the adjacent parcels. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. INSTRUCTIONS All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). ffany question in Section C on this form is answered "yes", then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken.
