MARIA STANISIC requests a Wetland Permit and Coastal Erosion Permit to reconstruct
approx. 118 If. of existing timber bulkhead in place utilizing steel sheeting; 30 cy. of clean fill
from an upland source is proposed landward of the reconstructed bulkhead as required to
match the existing adjacent grades; and to legalize the existing stairs, platforms and timber
retaining walls. Located: 19725 Soundview Ave., Southold. SCTM#51-4-1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP.
The platforms 6'x15' and 5'xll' are INCONSISTENT. The platforms do not meet section
275-11 Construction and operation standards, A (6) and are INCONSISTENT with LWRP
Policy 6.3 (below):
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.
275-11 Construction and operation standards.
A, General. The following standards are required for al! operations within the
jurisdiction of the Trustees:

Decks and platforms. No decks or platforms shall be permitted on or
near bluffs. Platforms associated with stairs may not be larger than
32 square feet. [Amended 10-11-2005 by L.L. No. 17-2005]
The platforms are 90 sq. ft. and 55 sq. ft.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants lbr permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permit~ not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this fom~ should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.
A copy of the LWRP is available kn the following places: online at the Town of Southold's
website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all
local libraries and the Town Clerk's office.

The applicant is proposing to reconstruct approximately 118 linear feet of existing timber
bulkhead in place utilizing steel sheeting. 30+/- cubic yards of clean fill from an upland source
is proposed landward of the reconstructed bulkhead as required to match the existing adjacent
grades. The applicant also proposes legalization of all existing stairs, platforms and timber
retaining walls as depicted on the project plans prepared by Land Use Ecological Services, Inc.

The purpose of the proposed project is for safe beach access and to protect and stabilize the
shoreline and bluff area. The existing bulkhead has deteriorated and is now failing. Therefore,
the reconstruction of the existing bulkhead would reduce any additional flooding and or erosion at
the site.
