Note that the Board of Trustees issued a wetland permit for JANE G. WEILAND to construct a 200
square foot on-ground boardwalk with built-in bench; with the condition that no treated lumber is to be
used on the decking of the structure; and as depicted on the site plan prepared by Studio aJb
Architects, last dated May 7, 2011, and stamped approved on May 11,2011.
JANE WEILAND #6472 - Request for Variance under Section 280-116, based on the Building
Inspector's April 5, 2011, Amended April 12, 2011 Notice of Disapproval concerning an application to
construct an accessory deck and shed, which proposed construction will be: 1 ) less than the code
required setback of 75 feet from the bulkhead; location: 6485 Nassau Point Rd., (adj. to Little Peconic
Bay) Cutchogue, NY SCTM#1000-111-13-11.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the action is
INCONSISTENT with the below denoted Policy Standards and therefore is INCONSISTENT with the
LWRP.
Policy 4.1 "Minimize losses of human life and structures from flooding and erosion hazards." The
following management measures to minimize losses of human life and structures from flooding
and erosion hazards are recommended: specifically
A. Minimize potential loss and damage by locating development and structures away from
flooding and erosion hazards.
Avoid development other than water-dependent uses in coastal hazard areas.
Locate new development which is not water-dependent as far away from coastal
hazard areas as practical.
The proposed action is located within a VE Flood Zone a Coastal high hazard
area - an area of special flood hazard extending from offshore to the inland
limit of a primary frontal dune along an open coast and any other area subject
to hi.qh velocity wave action from storms or seismic sources.
Move existing development and structures as far away from flooding and erosion
hazards as practical. Maintaining existing development and structures in hazard
areas may be warranted for:
structures which functionally require a location on the coast or in coastal
waters.
water-dependent uses which cannot avoid exposure to hazards.
sites in areas with extensive public investment, public infrastructure, or
major public facilities.
sites where relocation of an existing structure is not practical
The proposed action is not water dependent and does not meet any of the
listed criteria above.
2. Policy 6.3 Protect and restore tidal and freshwater wetlands.
Maintain buffers to ensure that adverse effects of adjacent or nearby development are avoided: 1. Maintain buffers to achieve a high filtration efficiency of surface runoff.
2. Avoid permanent or unnecessary disturbance within buffer areas.
3. Maintain existing indigenous vegetation within buffer areas.
The area in which the action is proposed is currently vegetated with American
beach grass (ammophilia spp.). The area is a vegetated buffer controlling and
filtering of surface runoff. The proposed action will result in unnecessary
disturbance and net loss of the vegetated buffer (vegetation) at the toe of the bluff
(see Figure 1).

Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

The boardwalk will be on a fiat terrain between the existinq cliff and bulkhead. The area is slaved
approx. 6.7% toward bulkhead, and sandy soil is evident with some scattered clumps of bushes. The cliff is
very steep, approx. 45 degree, and naturally vegetated. The boardwalk has been configured not to disturb
the naturally vegetated cliff to maintain the existing earth form and plants.
Please submit seven (7) photos, labeled to show different angles of yard areas after staking corners
for new construction), and photos of building area to be altered with yard view.

Construction of an on-ground boardwalk extending from the attached to the existing wood walkway, with a small
storage shed (32sf) and a bench, both attached to the boardwalk platform, total coverage is 326 sr.
The boardwalk decking will be on a fiat terrain at the base of a cliff. The boardwalk has been configured
not to disturb the naturally vegetated cliff to maintain the existing earth form and plants. No fill will be added
or removed. Minimal visual impact will be made viewed from the beach and water, as the surface will be
flush to the top of existing bulkhead. The shed and bench will be finished with cedar which will be a naturally
aged gray color.
