Building Inspector's May 31,2011 Notice of Disapproval based on an application for building permit for
additions and alterations to an existing dwelling at: 1 ) less than the code required setback of 75 feet
from a bulkhead, located at: 7180 Peconic Bay Blvd.,(adj. to Great Peconic Bay) Laurel, NY.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the action is
CONSISTENT with the LWRP policy standards and therefore CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the proposed
action.

FINDINGS OF FACT
PROPERTY FACTS: Applicants' property is a parcel of 37,576 sq. ft. lying bet,~en the
south side of Pecenic Bay Boulevard and Pesenic Bay in Laurel. A survey by Rodedck
Van Tuyl, Bated April 11, 1995, shows a bulkhead along Peconio Bay and two inner
bulkheads, and a house tocated at an angle of about 45 degrees to the bulkheads. At
the closest point (the southeast corner) the house appears to be about 57 feet from the
outer bulkhead.
BASIS FOR APPEAL: Building thspectoSs Notice of Disapproval, dated May 31, 2000,
~ler~ying a p~rmit {o build a dec~, 40 feet wide and 12 feet deep along the south side of
!he house facing the water, because it would be within 75 feet of the bulkhead in
9iolation of Code section 100-23.9.4.
RELIEF REQUESTED: AppIicants request authorization of the location of a 40 x 12 ft.
deck requested in the building permit application.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony
presented, matbdals submitted and personal inspection, the Board makes the following
findings:
(1) The location of the existing house is such that nothing can be added on the
south side, facit~g the water, without a vadance authorizing a structure within 75 feet of
the bulkhead on the Bay.
(2) Applicants have no deck of any sod on the waterfront side of the house. The
proposed deck is modest in scale and will not inten~ere with any neighbor's enjoyment of
the view Grant of the requested variance will not produce an undesirable change in the
character of the neighborhood or detriment to nearby properties.
(3) There is no evidence that grant of the requested vadance will have an
adverse effect or impact on physical or environmental conditions.
(4) The action set forth below is the minimum necessary apd adequate to enable
applicant to build a deck [acing the water while preserving and Protecting the character
of the neighborhood and the health, safety and welfare of the community.
RESOLUTION/AC"[ION: On motion by Member Collins, seconded by Chairman
Geehdnger, it was
RESOLVED, to GRANT a variance authorizing construction of a deck 40 feet
wide, attached to the south side of applicant's house and extending no more than 12 feet
from the wall of the house, subject to the following CONDITIONS:
(1) Any steps from the deck to the ground shall be within the 12-foot limit set forth
above.
(2) The deck shall be at all times open to the sky.
(3) As a condition for issuance of a Cer[ificate of Occupancy for the completed
deck, applicent shalt furnish to the Board, in wdting, a survey map or surveyor's
measurement of the distance between the deck and the o~er bulkhead at the closest
point, measured along a line drawn perpendicular to the bulkhead. Such measurement
shall be made a permanent part of the record of this variance.

Dinizio was absent due to illness.) This Resolution was duly ADOPTED (4-0).

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that arc subject to the Town of Southold Waterfront Consistenc,~ Review [,aw. This
assessment is intended to sopplement other information used by a Town of Southold agency in
making a determination of consistency. *Ercept minor exempt actions including Building Permits
and other ministerial permits not located within the Coaxtal Erosion Hazard Area.
Before ansx~ering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significnnt
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).

achievement of the LWRP policy standards and conditions cofitaincd in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
