INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permgt for an
addition six montks. Thereafter, a new permit ~hall be required.

FINDINGS, DELIBERATIONS AND DETERMINATION

Property Location: 1065 SaRaire Way, Mattituck; County Parcel 1000-100-1-2~J~
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type ti
category of the State's List of Actions, without an adverse effect on the environment if
the project is Implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 20.560 sq. fl.'parcel has 100 ff. of
frontage along the west side of Salteire Way and 207.21 ft. of lot depth along the south
property line. The property is improved with a 1-1/2 story frama-btick dwelling with
attached two-car garage and accessory playhouse structure behind the dwelling, as
shown on the March 10, 1989 survey prepared by William P,. Simmons, Jr., LB, for the
applicants,
BASIS OF APPLICATION: Building Department's October 2, 2002 Notice of
Disapproval, amended December 9, 2002, citing Section 100-244B, in its denial of a
building permit to construct a second-story addition to the existing dwelling proposed
within the code's 35 ft. minimum setback for both (total) side yards and less than 15 ff,
setback remaining on a single side yard.
FINDINGS OF FACT
The Zoning Board of Appeals held a public heating on this application on March20,
2003, at which time written and oral evidence were eresente(L Basea upon all
testimony, documentation, personal inseaction of the property, and other evidence, the
Zoning Board find~ the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a second-story
addition with a nonconforming total side yards of 33 feet, including the existing 13 ft.
setback from the south property line (and 20 ft. from the opposite side yard), as detailed
on the plans dated 5/2002, Job #02-19, by Peter T. Pedlas, A.I.A.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and Dereonal inspections the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties, The neighborhood is a well-
established subdivision situated on about one-half acre lots. The property is a non-

conforming 20,560 square foot lot in an R-40 zone containing a 1 *~ story house with
garage and decks. The applicants pmpcee to convert a potfion of the dwelling and
eXisting two-cari garage into a garage .with a two-story structure for a master
bedroom suite and to enlarge the other bedrooms. The ~equired [otal side yarc
se~fy,~s are 35 feet, the applicant with the,additions and alterations will maintain a
total Side yard setba~ of 33 feet.
2. The benefit sought by the applicants cannot be achieved by some o~er means other
than a varihnce. The house met the side yard mquiremants before the code was
chartged In. 1989~ when the total side yard ~equiremant was 25 I~eef- The applicants
are bailding over an eXisting structure and not ehlarging the original footprint of the
house.
3. The difficulty was self-created when the applicants decided to enlarge the dwelling.
4. The Vadance is not substantial as the total setbacks will be 33 feet instead of the
resuired 35 feel Total lot coverage is 15%.
The variance will not have an adverse effect or impact on the pnysical or
en~irdnmental conditions in the naighborheed or distdcL No evidence has been
sub~mitted to suggest that ti~ s variance will have an adveme impact on the physical
or environmental conditions in the neighborhood.
6. Grant of this requested variance is the m~nimum necessary for the applicant to enjoy
a secood-story addition over the existing garage for a new master bedroom suite.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying
the balancing test under New York Town Law, motion was offered by Member Oliva,
seconded by Chairwoman Tortora, and duly carried, to
GRANT the variance as applied for and shown on the plan dated 5/2002, Job

This action does not authorize or condone any current or future use, setback or other
