THIS INDENTURE, made the 17th day of February , nineteen hundred and ninety-nine
BETWEEN LOU ISE OVERTON DAY, residing at (no street address) Peconic
Lane, Peconic, New York 11958 owner of an 700/1000 undivided interest,
party of the first part,
and ROBERT OVERTON DAY, as to a 32 0/1000., undivided interest, CLAIRE
DUIGNAN DAY, his wife, as to A10n20/1000 undiivllded interest, MADELINE
DAY, as to a 30/1000 undivided A4 and LARRY JAMES DAY, as to a
30/1000 undivided interest, thfant. .issue ,of, ROBERT OVERTON DAY and
CLAIRE DUIGNAN DAY, all residing at 88 Wyckoff Street, Brooklyn, New
York 11201, as tenants in common, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and
other valuable consideration paid by the party of the second part, does hereby grant
and release unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever, a 700/1000 undivided interest in and to
DISTRICT ALL that certain plot, piece or parcel of land, with the buildings and improvements
1000 thereon erected, situate, lying and being at Peconic, Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:

TOGETHER with all right, title and interest, if any, of the party of the first part in
and to any streets and roads abutting the above described premises to the center lines
thereof; TOGETHER with the appurtenances and all the estate and rights of the party of
the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted
unto the party of the second part, the heirs and successors and assigns of the party of
the second part forever.
This conveyance, together with previous conveyances of the party of
the first part to the party of the second part constitutes ownership
of the subject premises as follows:
Robert Overton Day, owner of a 395/1000 undivided interest
Claire Duignan Day, owner of a 395/1000 undivided interest
Madeline Day, owner of a 105/1000 undivided interest
Harry James Day, owner of a 105/1000 undivided interest
AND the party of the first part covenants that the party of the first part has not done
or suffered anything whereby the said premises have been encumbered in any way
whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this
conveyance and will hold the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of the improvement and will apply the
same first to the payment of the cost of the improvement before using any part of the
total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.

ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being at Peconic, Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point on the easterly line of Indian Neck Road adjoining land conveyed
by the party of the first part to Winds Way Building Corp., said point being the
following four courses along Indian Neck Road from its intersection with the easterly
line of Parker's Landing:
1. N. 890 18' 10" E. - 209.91 feet; thence
2. S. 730 37' 00" E. - 392.79 feet; thence
3. N. 890 31' 30" E. - 279.10 feet; thence
9. S. 26° 28' 50" E. - 225.0 feet; to said point of beginning; running thence along
said lands of Winds Way Building Corp. two courses:
1. Due east - 305.0 feet; thence
2. N. 19° 00' W. - 907.0 feet to ordinary high water mark Richmond Creek; thence
