Reeves; running thence along the westerly line of land last mentioned South 13° 53 ' 20" East 65 feet to an iron pipe; running thence along the land now or formerly of Diaz the two following courses and distances: (1) South 160 00 ' 50" East 35 feet; and (2) South 73° 58 ' 10" West 115 . 66 feet to a point in the easterly line of Middleton Road; running thence North 160 01 ' 50" West along the easterly line of Middleton Road 119 . 12 feet to the iron pipe at the point or place of BEGINNING. SUBJECT TO a mortgage now a lien on the aforesaid premises, held by North Fork Bank f/k/a Southold Savings Bank, in the unpaid amount of $2 , 842 . 22 , which mortgage debt with interest thereon the party of the second part assumes and agrees to pay. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated March 13 , 1972 and recorded in the Suffolk County Clerk' s Office on April 26 , 1972 in Liber 7147 Page 473 . TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indentpre w requires.
