Located: 1570 Ole Jule Lane, Mattituck. SCTM#122-4-3 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP policy standards to the greatest extent practicable and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. RYes [-~ No ['~ Not Applicable As a permitted dock already exists at this site and numerous other dock structures characterize this residentially developed shoreline, installation of the proposed dock will not cause any "fragmentation of ecological communities," nor will construction of the dock result in the physical loss, degradation, or functional loss of ecological components, as the dock will be of open-pile construction; be elevated above grade of vegetated marsh, and utilize open-grate decking, all to allow for the persistence of vegetation beneath it. The decking will also be untreated, as noted under Policy 5. The project will meet the statutory & regulatory requirements of Article 25 of the NYS DEC and of Town Code Chapter 275, Wetlands, with the exception of the dock's intruding into the waterway more than the one-third waterway width allowed by Chapter 275 (see Policy 9 below). Yes V~ No ~ Not Applicable The proposed replacement dock has been designed and configured specifically to avoid interfering with the navigation of small to mid-sized vessels that can utilize the tidal creek on the opposing shoreline to gain access to James Creek. Although the proposed dock and approximately 9' vessel would extend seaward approximately 7 feet farther into the waterway then the one-third (+/-19) intrusion allowed by Chapter 275, there is no outlet to the north of the project site and no potential for dock construction on the opposing shoreline. As foot traffic is also not feasible along this shoreline due to the dense intertidal marsh and deep layer of fine, mucky soils, the project does not impede public access to nor recreational use of the waterway and is therefore consistent with Policy 9.
