ERIC KOENIG requests a Wetland Permit to construct a two-story, single-family residence with 1890
sf. first floor and 1605 sr. second floor, 406 sf. two car garage, 1755 sr. cellar, 233 sr. front porch, 198
sf. second floor roof deck and 295 sr. rear decks. Located: 610 Jackson Landing, Mattituck.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the below Policy Standards and therefore is CONSISTENT with the LWRP provided
the following best management practices are required to further the policies.

Poficy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
Maintain buffers to ensure that adverse effects of adjacent or nearby development are
avoided:
I. Maintain buffers to achieve a high filtration efficiency of surface runoff.
2. Avoid permanent or unnecessary disturbance within buffer areas,
3. Maintain existing indigenous vegetation within buffer areas.
It is recommended that the Board
1. Retain existing vegetation (trees) to the greatest extent practical.
2. Require the establishment of a natural vegetative buffer from the edge of tidal wetlands
line landward to the 6' contour line. An example definition of a buffer follows:
NATURAL VEGETATED BUFFER - a land area of a certain length and width where existing
vegetation occurs pdor to the commencement of any grading or clearing activity. Vegetation shall be
maintained to achieve a minimum percent ground cover of ninety-five (95) percent. To achieve the
percent ground cover indigenous, drought tolerant vegetation shall be planted. Survival of planted
vegetation shall be (ninety) 90 percent for a period of three (3) years. Maintenance activities within the
buffer are limited to removing vegetation which are hazardous to life and property, tdmmin.q tree limbs
up to a height of fifteen feet (15') to maintain viewsheds, replanting of vegetation and establishing a four
foot (4') wide access path or stairs constructed of pervious material for access to the water-body.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfi'ont Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.

All the erosion control measures proposed on the site, including but not limited to silt
fencing, staked hay bales, gradual regrading, seeded/grassed areas, and maintained wooded
areas and wetland areas, are measures to protect the shoreline from upland erosion. These
measures will also prevent sediment contamination of Mattituck Creek. There are no proposed
hardened shoreline installations, no bulkheads, and no land disturbance of the shoreline
areas. The property and shoreline are generally not considered to be erosion prone areas,
neither from tidal action or wave action.

The property has received Health approval for a suitable septic system design from the
Suffolk County Department of Health Services to treat and disperse all n~turally produced
human waste in an environmentally sensitive manner. The system has been design to protect
the quality of local water resources and prevent run off or contamination of the local
water supply. The property will not further tax the existing Southold well water supply
because it will receive water from the Suffolk County Water Authority. Additionally, the
NYS DEC reviewed the proposed septic design and given also given it's approval.

Construction and development on the proposed site is limited to the northern half
of the property, as dictated by the Suffolk County Department of Health Waste Water
management Department and also by the NYS DEC. No land clearing is to be allowed on
the southern portion of the property. The existing wetlands areas bordering Mattituck
Creek will be maintained. The existing wooded areas bordering the creek will be
maintained for ecological reasons, but also as a natural privacy buffer. A
comprehensive silt fence and staked hay bale system will be continuously maintained
to ensure no erosion or sediment makes it's way into the wetlands or the creek.
