David Corwin on behalf of BARBARA PAGANO requests a Wetland Permit to remove existing
bulkhead, install in same location 56 If. of vinyl bulkhead, reconstruct existing 6'X 20' wood float, 6'X 10'
wood float, 3'X 14' ramp, 3'X 6' platform, install two float anchor piles, and replace approx. 10 cy. lost
fill. Located: 2435 Cedar Lane, East Marion. SCTM#37-4-9
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
EXEMPT from LWRP review pursuant to:
§ 268-3. Definitions. MINOR ACTIONS item "B" which states:
B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same
site (inplace), including upgrading buildings to meet building or fire codes, except for structures
in areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not
be replaced, rehabilitated or reconstructed without a permit and shoreline erosion control
structures (including, but not limited to, groins, jetties, bulkheads, filled piers) located within
Great Peconic Bay, Cutchogue Harbor, Little Peconic Bay, Hog Neck Bay, Noyack Bay,
Southold Bay, Shelter Island Sound, Pipes Cove, Orient Harbor, Gardiners Bay, Long Island
Sound, Fishers Island Sound and Block Island Sound (excluding all creeks);
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWllP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's
website (southoldtown.norflffork.uet), the Board of Trustees Office, the Planning Depadment, all
local libraries and the Town Clerk's office.

Policy 2 Preserve historic resources of the Town of Southold.
There are no historical or archaeological artifacts in the vicinity of the area where
construction will be undertaken.
Policy 4 Minimize loss of life, structures, and natural resources from flooding and
erosion.
The odginal timber shore protection structure is deteriorated. A new vinyl sheet
bulkhead will be constructed along the same line as the existing bulkhead
Policy 5 Protect and improve water quality and supply in the Town of Southold.
5.3 Protect and enhance quality of coastal waters.
No excavation with a backhoe or clamshell bucket is anticipated in front of the existing
structure. Installation of vinyl sheets and piles will be with a water jet. The area behind
the existing structure will be excavated to allow the installation of a tie rod backing
system. Excavated area will use existing sand and some sand from an upland location
as backfill.
No discharge into coastal waters from the backing excavation is anticipated,

hand digging and water jet
A ten foot no-turf buffer will be restored behind the replaced bulkhead.
