Located: 2335 Cedar Lane, East Marion. SCTM#37-4-8 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided the following best management practice is required pursuant to: Policy 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trusteeslaws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions § 275-11. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area_ To further policy; 5.1. Prohibit direct or indirect discharges that would cause or contribute to contravention of water quality standards the following is recommended: There is potential for storm water and soil to enter the water body via the concrete way (raml3) durin.q excavation/construction. It is recommended that an erosion control and/or stu,m wate, re~untion draina.qe system be required for the area around the concrete ramp. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. There are no historical or archaeological artifacts in the vicinity of the area where construction will be undertaken. Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion. The original timber shore protection structure is deteriorated. A new vinyl sheet bulkhead will be constructed along the same line as the existing bulkhead Policy 5 Protect and improve water quality and supply in the Town of Southold. 5.3 Protect and enhance quality of coastal waters. No excavation with a backhoe or clamshell bucket is anticipated in front of the existing structure. Installation of vinyl sheets and piles will be with a water jet. The area behind the existing structure will be excavated to allow the installation of a tie rod backing system. Excavated area will use existing sand and some sand from an upland location as backfill. No discharge into coastal waters from the backing excavation is anticipated.
