James V. DeLucca, R.A. on behalf of MARY HUETTERMOSER requests a Wetland Permit to raise the
existing first floor elevation from 18.6' to 20.6' by adding three courses of concrete block to the existing
concrete block foundation walls; remove soil against the mar basement foundation wall to expose the
wall to provide a walk out on grade basement ama at elevation 11' and install windows and doors in
exposed mar foundation wall; regrade mar and side yards to install decorative concrete block retaining
walls to terrace existing sloping grade; rebuilding deteriorated concrete block walls; and in rear, side
and front yards install wood decks and exit wood stairs in side yards. Located: 2235 Cedar Lane, East
Marion. SCTM#37-4-7
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided the
following best management practice is required pursuant to:
Policy 6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trusteeslaws and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions
§ 275-11. Construction and operation standards.
A. General. The following standards are required for all operations within the
jurisdiction of the Trustees:

Erosion control. Installation of an erosion control structure is necessary during any
building, grading, landscaping or site work activity within Trustee jurisdiction. This
structure may include, but is not limited to, installation of a silt fence, hay bales, wood
chip berm and silt booms. The placement of the erosion control structure(s) shall be
determined by the Trustees or their designee. All intertidal construction and
excavation requires the installation of a silt boom that will retain all suspended
sediments within the immediate project area.
To further policy; 5.1. Prohibit direct or indirect discharges that would cause or contribute to
contravention of water quality standards the following is recommended:
It is not indicated what chan.qes (if any) would be made to the concrete boat ramp. Due to the
potential storm water runoff capable of enterin.q the water body via the concrete ramp, a storm
water retention drainaqe system for the concrete ramp should be required (trench drain).
Further, due to the decks close proximity to the water body and overhan.q of the concrete ramp
it is recommended that the Board prohibit CCA treated materials in deck construction,
In addition to the required erosion control measures, it is recommended that the Board desi.qn
site specific erosion control measures to be employed afJaround the concrete ramp durin.q
excavation/construction operations.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfxont Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including, Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus~ each answer must be explained in detafl~ listing both supporting and non-
suooortim, facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

local libraries and the Town Clerk's office.
