Proposed Wetland Permit for DONNA SALMINEN

Suffolk Environmental Consulting, Inc. on behalf of DONNA SALMINEN requests a Wetland Permit to
install a vinyl-sheathed retaining wall along the bottom of bank within the eastern section of subject
property, measuring 65' long (inclusive of a 6' long vinyl sheathed return), which is to measure 4' in
height; backfill behind the proposed retaining wall with 100 cy. of clean fill obtained from an approved
upland source. Located: 320 Lake View Terrace, East Marion. SCTM#31-9-13
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with the
LWRP.
Policy 4. 1 Minimize losses of human life and structures from flooding and erosion hazards
B. Use vegetative non-structural measures to manage flooding and erosion hazards.
Use veqetative non-structural measures which have a reasonable probability of
managinq flooding and erosion, based on shoreline characteristics includinq
exposure, qeometry, and sediment composition.
Use veqetative measures to increase protective capabilities of natural protective
features.
Discouraqe clearinq of existinq, particularly ind{qenous veqetation during siting,
des{qn, construction and re qrading phases of any development proiect.

2. Vegetative approaches to controlling erosion are not effective.
The proposal includes disturbance (back filling of existing vegetation) that is currently
stabilizing the bank (see Figure 1). It is recommended that the Board consider an erosion
control method that utilizes natural, untreated materials (rocks) and includes the integration of
existing vegetation to stabilize the toe of the slope. The top of bank (bluff) should also be
evaluated to determine if storm water runoff is affecting the stability of the slope.

Further, the proposed action does not include the re-vegetation of disturbed areas and/or on the
backfilled section. If the Board approves the plans as submitted, it is recommended that
minimal impact to existing vegetation is required and that the backfilled area be vegetated with
appropriate species.
Erosion control measures are not specified. In the event an action is approved, to further Policy
5 and 6 it is recommended that erosion control measures are required.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM--

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exentpt actions including Buildiug Permits'
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office.

Subject proposal is consistent with the policy in that the sitinq and utilization of the proposed retainim] wall will
reflect the general character of the immediate neighborhood, specifically along this section of Marion Lake, in that
a substantial amount of properties are also improved with similar erosion-control structures (i.e. bulkheading and
retaininq walls). In addition, subject proposal will be harmonious with the "...beneficial use of a coastal location..."
given that subject waterfront lot will be enhanced and improved by maintaining the existing bluff, preventing
erosion thereon. Accordingly, we believe that this project is consistent with this policy.

retaining wall along the bottom of the bank to prevent any erosion of the bluff. The existinq bulkheads and
retaininq walls located within neighborinq properties have existed harmoniously for years within this environment
without resulting in any form of discernible adverse effects. Accordingly, this proposal will comply with Policy 6.
